AN ACT 1 Amending the act of June 29, 1976 (P.L.469, No.117), entitled 2 "An act relating to the fiscal affairs of the Commonwealth 3 concerning duties of the Governor, the Secretary of Revenue 4 and the Budget Secretary, with respect to the submission of 5 and signing the budget for any fiscal year; and, after a 6 budget is enacted, regulating the issuance of warrants by the 7 State Treasurer for certain requisitioned funds and imposing 8 duties on persons authorized by law to issue requisitions for 9 the payment of moneys from the State Treasury; and 10 prescribing that Federal funds received by the Commonwealth 11 shall be deposited in the General Fund account with certain 12 exceptions," providing for the distribution of Job Training 13 Partnership Act funds during periods of budget impasse. 14 The General Assembly of the Commonwealth of Pennsylvania 15 hereby enacts as follows: 16 Section 1. The act of June 29, 1976 (P.L.469, No.117), 17 entitled "An act relating to the fiscal affairs of the 18 Commonwealth concerning duties of the Governor, the Secretary of 19 Revenue and the Budget Secretary, with respect to the submission 20 of and signing the budget for any fiscal year; and, after a 21 budget is enacted, regulating the issuance of warrants by the 22 State Treasurer for certain requisitioned funds and imposing 23 duties on persons authorized by law to issue requisitions for
1 the payment of moneys from the State Treasury; and prescribing 2 that Federal funds received by the Commonwealth shall be 3 deposited in the General Fund account with certain exceptions," 4 is amended by adding a section to read: 5 Section 5.1. (a) In accordance with the requirements of 6 section 5, there is hereby established in the State Treasury a 7 special restricted receipts account to be known as the JTPA 8 Account. This account shall receive all funds from the Federal 9 Government pursuant to the Job Training Partnership Act (Public 10 Law 97-300, 29 U.S.C. § 1501, et seq.). 11 (b) These funds shall be distributed to those agencies 12 entitled to receive same in accordance with such existing 13 statutory appropriations as may apply. If, during any period of 14 any fiscal year there exists no valid statutory appropriation, 15 the State Treasurer is hereby directed to make any scheduled 16 distributions of these funds as if the last valid appropriation 17 still applied, and regardless of any executive order to the 18 contrary. 19 Section 2.
