                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for grading for
     3     criminal mischief.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3304 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3304.  Criminal mischief.
     9     (a)  Offense defined.--A person is guilty of criminal
    10  mischief if he:
    11         (1)  damages tangible property of another intentionally,
    12     recklessly, or by negligence in the employment of fire,
    13     explosives, or other dangerous means listed in section
    14     3302(a) [of this title] (relating to causing or risking
    15     catastrophe);
    16         (2)  intentionally or recklessly tampers with tangible


     1     property of another so as to endanger person or property; or
     2         (3)  intentionally or recklessly causes another to suffer
     3     pecuniary loss by deception or threat.
     4     (b)  Grading.--Criminal mischief is a felony of the third
     5  degree if the actor intentionally causes pecuniary loss in
     6  excess of $5,000, or a substantial interruption or impairment of
     7  public communication, transportation, supply of water, gas or
     8  power, or other public service. It is a misdemeanor of the
     9  second degree if the actor intentionally causes pecuniary loss
    10  in excess of $1,000, or causes an unsubstantial interruption or
    11  impairment of public communication, transportation, supply of
    12  water, gas or power, or other public service. It is a
    13  misdemeanor of the third degree if he intentionally or
    14  recklessly causes pecuniary loss in excess of $500. Otherwise
    15  criminal mischief is a summary offense.
    16     Section 2.  This act shall take effect immediately.
