                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the payment of tax on
     3     vehicles purchased from dealers; and making repeals.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1103.1 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 1103.1.  Application for certificate of title.
     9     * * *
    10     (d.1)  Method of tax payment.--
    11         (1)  Any tax payable by an applicant on a vehicle
    12     purchased from a dealer shall be paid by separate check
    13     issued in the correct amount of the tax and made payable to
    14     the Commonwealth of Pennsylvania. The dealer shall forward
    15     this check with the application for registration to the
    16     department.
    17         (2)  All banks, savings institutions, credit unions,


     1     finance and loan companies and other persons, firms and
     2     corporations making secured motor vehicle loans shall issue
     3     the separate check required under paragraph (1) upon request
     4     of the prospective purchaser. It shall be unlawful for any
     5     such institution to refuse to issue this check. The issuance
     6     of these checks shall not affect or impair any security
     7     interest of the lending entity in the motor vehicle.

     9     Section 2.  Chapter 23 of Title 75 is repealed.
    10     Section 3.  All acts and parts of acts are repealed insofar
    11  as they are inconsistent with this act.
    12     Section 4.  This act shall take effect in 60 days.
