                                  A SUPPLEMENT

     1  To the act of              (P.L.    , No.    ), entitled "An act
     2     providing for the capital budget for the fiscal year 1991-
     3     1992," itemizing public highway projects to be constructed by
     4     the Department of Transportation, together with the estimated
     5     financial costs; authorizing the incurring of debt without
     6     the approval of the electors for the purpose of financing the
     7     projects to be constructed by the Department of
     8     Transportation; stating the estimated useful life of the
     9     projects; and making appropriations.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12  Section 1.  Short title.
    13     This act shall be known and may be cited as the Highway
    14  Supplement to the Capital Budget Act of 1991-1992.
    15  Section 2.  Authorization.
    16     The total authorization for the capital projects in the
    17  category of highway projects itemized in section 3 and to be
    18  constructed by the Department of Transportation, its successors
    19  or assigns, and to be financed by the incurring of debt, or from
    20  current revenues of the Motor License Fund, shall be $8,200,000.
    21  Section 3.  Itemization.

     1     Additional capital projects in the category of public highway
     2  projects to be constructed by the Department of Transportation,
     3  its successors or assigns, and to be financed by the incurring
     4  of debt, or from current revenues of the Motor License Fund, are
     5  hereby itemized, together with their respective estimated
     6  financial costs, as follows:

    20  Section 4.  Debt authorization.
    21     The Governor, Auditor General and State Treasurer are hereby
    22  authorized and directed to borrow, from time to time, in
    23  addition to any authorization heretofore or hereafter enacted,
    24  on the credit of the Commonwealth, subject to the limitations
    25  provided in the current capital budget, money not exceeding in
    26  the aggregate the sum of $8,200,000 as may be found necessary to
    27  carry out the acquisition and construction of the highway
    28  projects, specifically itemized in section 3 of this capital
    29  budget.
    30  Section 5.  Issue of bonds.

     1     The indebtedness herein authorized shall be incurred from
     2  time to time and shall be evidenced by one or more series of
     3  general obligation bonds of the Commonwealth in such aggregate
     4  principal amount for each series as the Governor, Auditor
     5  General and State Treasurer shall determine, but the latest
     6  stated maturity date shall not exceed 30 years from the date of
     7  the bond first issued for each such series.
     8  Section 6.  Estimated useful life of projects.
     9     The General Assembly states the estimated useful life of the
    10  projects heretofore itemized is 30 years.
    11  Section 7.  Appropriation.
    12     The net proceeds of the sale of the obligations herein
    13  authorized are hereby appropriated from the Capital Facilities
    14  Fund to the Pennsylvania Department of Transportation in the
    15  maximum amount of $8,200,000 to be used by it exclusively to
    16  defray the financial costs of the projects specifically itemized
    17  in section 3 of this capital budget. After reserving or paying
    18  the expenses of the sale of the obligation, the State Treasurer
    19  shall pay out to the Pennsylvania Department of Transportation
    20  the moneys as required and certified by it to be legally due and
    21  payable.
    22  Section 8.  Federal funds.
    23     In addition to those funds appropriated in section 7, all
    24  moneys received from the Federal Government for the construction
    25  of the public improvement projects specifically itemized herein
    26  are also hereby appropriated for those projects.
    27  Section 9.  Allocation of funds.
    28     Whenever as determined by the Pennsylvania Department of
    29  Transportation that the full estimated financial costs of the
    30  projects itemized in section 3 are not necessary for the proper

     1  design, acquisition or construction of such projects, the excess
     2  funds no longer required may be allocated by the Pennsylvania
     3  Department of Transportation to increase the estimated costs of
     4  any one or more of the projects specifically itemized in a
     5  capital budget.
     6  Section 10.  Effective date.
     7     This act shall take effect immediately.
