AN ACT 1 Amending the act of July 28, 1953 (P.L.723, No.230), entitled, 2 as amended, "An act relating to counties of the second class 3 and second class A; amending, revising, consolidating and 4 changing the laws relating thereto," authorizing the county 5 commissioners in counties of the second class to impose a fee 6 on civil and criminal cases filed in the court of common 7 pleas to help defray the cost of maintaining records. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 405 of the act of July 28, 1953 (P.L.723, 11 No.230), known as the Second Class County Code, is amended by 12 adding a subsection to read: 13 Section 405. Offices, Records and Papers.--* * * 14 (a.2) The county commissioners shall have the power to 15 impose a fee on recorded instruments required to be kept 16 permanently that are filed with the county. The county 17 commissioners, with the approval of the president judge shall 18 have the power to impose a fee on civil or criminal cases filed 19 in the court of common pleas. The fees will be collected by the 20 appropriate row officer and deposited in a special records
1 management fund, administered by the county's records management 2 program in the Office of Management and Productivity. The fund 3 shall be solely used to help defray the cost of maintaining, 4 administering, preserving and caring for the records of the 5 county. 6 * * * 7 Section 2.
