                                     AN ACT

     1  Requiring municipal or authority service providers to take
     2     responsibility for repairs and reconstruction of roads and
     3     highways; and making repeals.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Definitions.
     7     The following words and phrases when used in this act shall
     8  have the meanings given to them in this section unless the
     9  context clearly indicates otherwise:
    10     "Provider."  Includes, but need not be limited to, all
    11  authorities incorporated under the act of May 2, 1945 (P.L.382,
    12  No.164), known as the Municipality Authorities Act of 1945, or
    13  any other statute, all water or sewer facilities owned, operated
    14  or leased by local municipal or county governments and all water
    15  or sewer facilities owned, operated or leased by any public or
    16  quasi-public body which provides such services to the public.
    17  Section 2.  Responsibility.

     1     All providers shall be responsible for all costs incurred in
     2  the reconstruction, repair and resurfacing of any public or
     3  private road or highway, including, if needed, costs associated
     4  with signage, drainage or other appurtenance maintenance
     5  whenever it is found necessary to dig up the highway or road in
     6  order to connect, repair or restructure a facility user's
     7  service line to the provider's main service line. Any bonding
     8  costs associated with the work shall be the obligation of the
     9  provider.
    10  Section 3.  Repeals.
    11     All acts and parts of acts are repealed insofar as they are
    12  inconsistent with this act.
    13  Section 4.  Effective date.
    14     This act shall take effect in 60 days.
