AN ACT 1 Amending the act of May 4, 1983 (P.L.4, No.3), entitled "An act 2 amending Title 75 (Vehicles) of the Pennsylvania Consolidated 3 Statutes, further providing for expenditures for the motor 4 vehicle emission inspection program; establishing a credit 5 program for certain inspection fees; further providing for 6 certain bonding requirements; providing a penalty; 7 establishing a new program for monitoring vehicle emission 8 and vehicle safety inspection; and making a repeal," 9 providing for the Department of Transportation to purchase 10 emission inspection equipment in connection with the 11 abolition of the motor vehicle emission inspection program; 12 making an appropriation; and making repeals. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. The act of May 4, 1983 (P.L.4, No.3), entitled 16 "An act amending Title 75 (Vehicles) of the Pennsylvania 17 Consolidated Statutes, further providing for expenditures for 18 the motor vehicle emission inspection program; establishing a 19 credit program for certain inspection fees; further providing 20 for certain bonding requirements; providing a penalty; 21 establishing a new program for monitoring vehicle emission and 22 vehicle safety inspection; and making a repeal," is amended by
1 adding a section to read: 2 Section 6.1. Upon the abolition of the Commonwealth's 3 vehicle emission inspection program, the Department of 4 Transportation shall purchase emission inspection equipment from 5 official emission inspection stations. To receive the purchase 6 price under this section, an official emission inspection 7 station shall bring the equipment to a local office of the 8 Department of Transportation for appraisal and purchase. If an 9 official emission inspection station disagrees with the 10 appraisal of the local office, it may appeal to the Secretary of 11 Transportation. The decision of the secretary is a final order 12 for purposes of appeal under 2 Pa.C.S. Ch. 7 Subch. A (relating 13 to judicial review of Commonwealth agency action). 14 Section 2. The sum of $ , or as much thereof as may be 15 necessary, is hereby appropriated to the Department of 16 Transportation for the fiscal year July 1, 1991, to June 30, 17 1992, to carry out the purposes of this act. 18 Section 3. The provisions of 75 Pa.C.S. §§ 4531 and 4706 are 19 repealed. 20 Section 4. This act shall take effect in 180 days. A14L75JRW/19910H0663B0728 - 2 -
