                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, relating to the reduction of certain speed limits.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Sections 3363 and 3365(b) of Title 75 of the
     6  Pennsylvania Consolidated Statutes are amended to read:
     7  § 3363.  Alteration of maximum limits.
     8     The department or local authorities on highways under their
     9  respective jurisdictions, upon the basis of an engineering and
    10  traffic investigation, may determine that the maximum speed
    11  permitted under this subchapter is greater or less than is
    12  reasonable and safe under the conditions found to exist upon any
    13  such highway or part thereof and establish a reasonable and safe
    14  maximum limit. The maximum speed limit may be made effective at
    15  all times or at times indicated and may vary for different
    16  weather conditions and other factors bearing on safe speeds. No


     1  maximum speed greater than 55 miles per hour shall be
     2  established under this section. The department shall reduce by
     3  no more than ten miles per hour the speed limit on State
     4  highways located in municipalities, other than limited access
     5  highways, when a reduction is requested by the local authorities
     6  by means of an ordinance or resolution adopted by the governing
     7  body of the local authority, which request shall be accompanied
     8  by an engineering study that finds that the existing speed limit
     9  is excessive. The department shall lower the speed limit in
    10  residential districts when requested by the municipality by
    11  using the standard traffic study data, except that the
    12  percentile speed used shall be the 40th percentile and no other.
    13  In no event shall the speed limit be reduced to less than 25
    14  miles per hour.
    15  § 3365.  Special speed limitations.

    17     (b)  School zones.--When passing a school zone as defined and
    18  established under regulations of the department, no person shall
    19  drive a vehicle at a speed greater than 15 miles per hour. An
    20  official traffic-control device shall indicate the beginning and
    21  end of each school zone to traffic approaching in each
    22  direction, and, on a State highway having a designated speed of
    23  55 miles per hour, at least 1,500 feet of highway immediately
    24  approaching the indicated school zone from either direction
    25  shall have a reduced speed limit of not more than 45 miles per
    26  hour. Establishment of a school zone, including its location and
    27  hours of operation, shall be approved by the department.
