HOUSE RESOLUTION

No. 382 Session of 1990


        INTRODUCED BY PESCI, SAURMAN, CAPPABIANCA, BATTISTO, BILLOW,
           PISTELLA, ANGSTADT, RITTER, DeLUCA, TANGRETTI, TIGUE,
           E. Z. TAYLOR, TRELLO, COLAIZZO AND RUDY, NOVEMBER 12, 1990

        REFERRED TO COMMITTEE ON RULES, NOVEMBER 12, 1990

                            A CONCURRENT RESOLUTION

     1  Establishing a Special Domestic Relations Task Force to
     2     investigate the injustices of domestic relations judicial
     3     proceedings.

     4     WHEREAS, The Pennsylvania Rules of Civil Procedure are being
     5  violated in domestic relations cases on a daily basis; and
     6     WHEREAS, There is extensive documentation of these
     7  violations; and
     8     WHEREAS, Many litigants are being denied due process as a
     9  result of clandestine, out-of-court settlements; and
    10     WHEREAS, Approximately 93% of all complaints brought to the
    11  Judicial Inquiry and Review Board and the Disciplinary Board of
    12  the Supreme Court are dismissed; and
    13     WHEREAS, The injustices in domestic relations court have
    14  driven litigants to financial and emotional distress; therefore
    15  be it
    16     RESOLVED (the Senate concurring), That the General Assembly
    17  establish a Special Domestic Relations Task Force to investigate
    18  the injustices occurring in domestic relations court; and be it

     2     RESOLVED, That the task force be comprised of seven members,
     3  as follows: two members of the General Assembly, two
     4  representatives from an organization acting on behalf of the
     5  litigants, one retired judge with extensive family law
     6  experience, one retired attorney with extensive family law
     7  experience, and one official from the Department of Public
     8  Welfare; and be it further
     9     RESOLVED, That the Lieutenant Governor appoint individuals to
    10  the task force; and be it further
    11     RESOLVED, That the task force submit a report of its findings
    12  and recommendations to the General Assembly within 18 months;
    13  and be it further
    14     RESOLVED, Than an appropriation be made to the Department of
    15  Public Welfare to enable the task force to conduct a thorough
    16  investigation.
