HOUSE RESOLUTION

        INTRODUCED BY MARKOSEK, SAURMAN, COWELL, JACKSON, SCHULER,
           LaGROTTA AND RUDY, APRIL 3, 1989

        REFERRED TO COMMITTEE ON RULES, APRIL 3, 1989

                                  A RESOLUTION

     1  Memorializing Congress to expand the criteria for Medicaid
     2     reimbursement of the cost of Community Living Arrangements
     3     for persons who have autism.

     4     WHEREAS, Persons with autism are eligible, under Federal
     5  guidelines, to receive Supplemental Security Income; and
     6     WHEREAS, Eligibility for Supplemental Security Income
     7  automatically renders them eligible for Medical Assistance; and
     8     WHEREAS, Medical Assistance pays for the care of other
     9  mentally disabled people in Community Living Arrangements; and
    10     WHEREAS, This care is not reimbursable, under Federal
    11  guidelines, for persons who have autism; and
    12     WHEREAS, This dichotomy within Federal regulations excludes
    13  autistic people from living in a supervised setting within the
    14  community; and
    15     WHEREAS, This Federal conflict is inequitable and needs to be
    16  changed; therefore be it
    17     RESOLVED, That the House of Representatives of the
    18  Commonwealth of Pennsylvania memorialize the Congress of the

     1  United States to address the issue of Medicaid reimbursement to
     2  include autistic people among those eligible to receive
     3  community-based residential care; and be it further
     4     RESOLVED, That copies of this resolution be transmitted to
     5  the presiding officers of each house of Congress and to each
     6  member of Congress from Pennsylvania.
