                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing a penalty for certain
     3     employees of institutions of higher education for failure to
     4     report knowledge of drug usage by students to the proper
     5     authorities.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 18 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 7509.  Failure to report student drug offenses to authorities.
    11     (a)  Offense defined.--An administrator of any college,
    12  university, junior college or other institution of higher
    13  education commits a misdemeanor of the third degree if he fails
    14  to notify the local police or the Attorney General of any
    15  knowledge he has that a student that attends his institution has
    16  violated any drug laws, including, but not limited to, the Anti-
    17  Drug Act of 1988 (Public Law 100-690, 21 U.S.C. § 1501 et seq.)
    18  or the act of April 14, 1972 (P.L.233, No.64), known as The


     1  Controlled Substance, Drug, Device and Cosmetic Act.
     2     (b)  Definition.--As used in this section, the term
     3  "administrator" means any dean, president or chancellor of the
     4  school.
     5     Section 2.  This act shall take effect immediately.
