HOUSE BILL

No. 2825 Session of 1990


        INTRODUCED BY LEVDANSKY, TRICH, FOX, PISTELLA, JOSEPHS,
           E. Z. TAYLOR, MORRIS, FREEMAN, FAIRCHILD, MELIO, BELFANTI,
           TANGRETTI, JOHNSON, DeLUCA AND PRESTON, JULY 1, 1990

        REFERRED TO COMMITTEE ON STATE GOVERNMENT, JULY 1, 1990

                               A JOINT RESOLUTION

     1  Proposing an amendment to the Constitution of the Commonwealth
     2     of Pennsylvania, limiting the prohibition on impairment of
     3     contracts.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby resolves as follows:
     6     Section 1.  The following amendment to the Constitution of
     7  Pennsylvania is proposed in accordance with Article XI:
     8     That Section 17 of Article I be amended to read:
     9                             ARTICLE I
    10                       DECLARATION OF RIGHTS
    11  § 17.  Ex post facto laws; impairment of contracts.
    12     No ex post facto law, nor any law impairing the obligation of
    13  contracts except in the case of requiring pension forfeiture for
    14  a public official sentenced for a crime, or making irrevocable
    15  any grant of special privileges or immunities, shall be passed.
    16     Section 2.  This proposed amendment shall be submitted by the
    17  Secretary of the Commonwealth to the qualified electors of this


     1  Commonwealth at the primary, general or municipal election next
     2  held after the advertising requirements of section 1 of Article
     3  XI of the Constitution of Pennsylvania have been satisfied.
