AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for transporting
3 animals in a cruel or inhumane manner.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5511(e) of Title 18 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5511. Cruelty to animals.

10 (e) Transporting animals in cruel manner.--
11 (1) A person commits a summary offense if he carries, or
12 causes, or allows to be carried in or upon any cart, or other
13 vehicle whatsoever, any animal in a cruel or inhumane manner.
14 The person taking him into custody may take charge of the
15 animal and of any such vehicle and its contents, and deposit
16 the same in some safe place of custody, and any necessary
17 expenses which may be incurred for taking charge of and
18 keeping the same, and sustaining any such animal, shall be a
1 lien thereon, to be paid before the same can lawfully be
2 recovered, or the said expenses or any part thereof remaining
3 unpaid may be recovered by the person incurring the same from
4 the owner of said creature in any action therefor.
5 (2) For the purposes of this section, it shall not be
6 deemed cruel or inhumane to transport live poultry in crates
7 so long as not more than 15 pounds of live poultry are
8 allocated to each cubic foot of space in the crate.
9 (3) For purposes of this section, it shall be deemed
10 cruel or inhumane to transport any unrestrained dog in the
11 open bed of any pickup truck or other vehicle.
