                                     AN ACT

     1  Amending the act of April 6, 1951 (P.L.69, No.20), entitled "An
     2     act relating to the rights, obligations and liabilities of
     3     landlord and tenant and of parties dealing with them and
     4     amending, revising, changing and consolidating the law
     5     relating thereto," providing an exception for breach of lease
     6     by senior citizens and disabled persons.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 102 of the act of April 6, 1951 (P.L.69,
    10  No.20), known as The Landlord and Tenant Act of 1951, is amended
    11  by adding definitions to read:
    12     Section 102.  Definitions.--As used in this act--
    13     * * *
    14     (6)  "Senior citizen" shall include those persons residing
    15  within Pennsylvania who are sixty years of age or older or other
    16  persons authorized by law as the Secretary of Aging may
    17  determine.
    18     (7)  "Handicapped" or "special needs" tenant shall include
    19  those persons having a physical or mental impairment which
    20  substantially limits one or more major life activities, has a

     1  record of an impairment or is regarded as having an impairment.
     2  Proof that a claimant is eligible to receive disability benefits
     3  under the Social Security Act (Public Law 74-271, 42 U.S.C. §
     4  301 et seq.) shall constitute proof of disability under this
     5  act.
     6     Section 2.  The act is amended by adding a section to read:
     7     Section 207.  Breach of Lease; Senior Citizens, Handicapped
     8  Persons; Specialized Care Facilities.--Senior citizens,
     9  handicapped persons and special needs tenants awaiting admission
    10  to a senior citizen or specialized care facility shall not be
    11  liable for breach of lease for vacating a leased rental unit
    12  which they occupy prior to the termination of the lease if the
    13  reason for early termination is that the person has been
    14  admitted to a senior citizen or specialized care facility.
    15     Section 3.  This act shall take effect in 60 days.
