                                     AN ACT

     1  Amending the act of May 23, 1945 (P.L.926, No.369), entitled, as
     2     amended, "An act for the protection of the public health by
     3     regulating the conduct and operation of public eating and
     4     drinking places within this Commonwealth; requiring their
     5     licensing; imposing certain duties on the Department of
     6     Environmental Resources of this Commonwealth and on the local
     7     health authorities; and providing penalties," requiring food
     8     handlers to wear nonreusable sanitary gloves when handling
     9     food.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 9 of the act of May 23, 1945 (P.L.926,
    13  No.369), referred to as the Public Eating and Drinking Place
    14  Law, is amended to read:
    15     Section 9.  In every public eating or drinking place,
    16  kitchens, dining rooms, cellars, ice-boxes, refrigerators and
    17  all places where foods are prepared, kept or stored and all
    18  kitchen-ware, table-ware, glass-ware, cutlery, utensils,
    19  containers or other utensils and machinery used in moving,
    20  handling, cutting, mixing, preparing or serving foods shall be

     1  kept in a clean and sanitary condition and be protected from
     2  dust, dirt, insects and vermin in the manner prescribed by the
     3  regulations of the department. The clothing and hands of
     4  employes shall at all times be clean and sanitary. In addition,
     5  employes shall wear nonreusable sanitary gloves when handling
     6  food. No domestic pets or other animals shall be permitted where
     7  food or drink is prepared, handled or stored. No person shall be
     8  permitted to use for sleeping purposes any room or place in any
     9  public eating or drinking place which is regularly and
    10  customarily used for the preparation, handling, storing or
    11  serving of food.
    12     Section 2.  This act shall take effect in 60 days.
