                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for residency
     6     requirements for workers removing asbestos.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 754 of the act of March 10, 1949 (P.L.30,
    10  No.14), known as the Public School Code of 1949, is amended to
    11  read:
    12     Section 754.  Contracts to Provide for Resident Workmen;
    13  Penalty.--(a)  The specifications upon which contracts are
    14  entered into by any school district for the construction,
    15  alteration, or repair of any public works, shall contain the
    16  provision that laborers and mechanics employed on such public
    17  works shall have been residents of the Commonwealth for at least
    18  ninety days prior to their employment. Failure to keep and
    19  comply with such provision shall be sufficient legal reason to

     1  refuse payment of the contract price to the contractor.
     2     (b)  This section shall not be applicable to contracts
     3  entered into for the removal, maintenance, or repair of asbestos
     4  containing materials from school district buildings in
     5  accordance with an approved asbestos abatement plan adopted by a
     6  school district pursuant to the provisions of the act of October
     7  22, 1986 (Public Law 99-519, 100 Stat. 2970), known as "The
     8  Asbestos Hazard Emergency Response Act of 1986".
     9     Section 2.  This act shall take effect immediately.
