        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, JUNE 30, 1990

                                     AN ACT

     1  Requiring the superintendent of every public school district to
     2     make available, upon request, lists of graduating seniors to
     3     armed forces recruiters; and providing a penalty for the
     4     misuse of any such lists.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Legislative intent.
     8     It is the intent of the General Assembly through this
     9  legislation to assist armed forces recruiters to achieve
    10  additional access to potential recruits by compiling a list of
    11  prospective graduating seniors for distribution, upon written
    12  request, to armed forces recruiters for the cost thereof, for
    13  recruiting purposes only.
    14  Section 2.  List of seniors to be compiled.
    15     (a)  Lists.--Subject to the limitations of subsection (b),


     1  the superintendent of every public school district, except as
     2  otherwise provided, shall compile a list of senior students,      <--
     3  both male and female, including home address and published
     4  telephone number MAKE AVAILABLE TO ALL ARMED FORCES RECRUITERS    <--
     5  FOR THE ACTIVE COMPONENT, RESERVE COMPONENT AND NATIONAL GUARD
     6  COMPONENT OF THE ARMED FORCES, THE SAME ACCESS TO SENIOR
     7  STUDENTS AS IS AVAILABLE TO INSTITUTIONS OF HIGHER EDUCATION AND
     8  TRADE SCHOOLS. ACCESS SHALL INCLUDE, BUT NOT BE LIMITED TO, A
     9  LIST OF SENIOR MALE AND FEMALE STUDENTS BY NAME, HOME ADDRESS
    10  AND, IF PUBLISHED, TELEPHONE NUMBER, who at the end of the
    11  respective academic year will graduate from the school system.
    12  The list shall be compiled within 45 calendar days of the
    13  effective date of this act and in succeeding years by the first
    14  day of the academic year in which the senior students will
    15  graduate.
    16     (b)  Notification.--Each school district shall notify the
    17  students, in writing, prior to the end of their junior year, of
    18  the requirements imposed by subsection (a). Each student shall
    19  be given at least 21 calendar days to request, in writing, to
    20  the superintendent, exclusion of such student's name prior to
    21  the release of such list.
    22  Section 3.  Optional compliance by nonpublic schools.
    23     The governing body or board of each parochial, licensed
    24  private and nonpublic school shall determine whether or not to
    25  comply with the provisions of this act. If an affirmative
    26  determination is made, then the principal of that parochial,
    27  licensed private or nonpublic school shall comply with the
    28  provisions of sections 2, 4 and 5 of this act AND 4.              <--
    29  Section 4.  List to be made available.                            <--
    30     The list shall be made available to armed forces recruiters

     1  for the active component, the reserve component and the National
     2  Guard component of the armed forces.
     3  Section 5 4.  Penalties.                                          <--
     4     A person who violates this act commits a summary offense and
     5  shall, upon conviction, be sentenced to pay a fine of $100. Each
     6  day that a person violates this act shall constitute a separate
     7  offense.
     8  Section 6 5.  Effective date.                                     <--
     9     This act shall take effect immediately.
