AN ACT 1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled 2 "An act concerning elections, including general, municipal, 3 special and primary elections, the nomination of candidates, 4 primary and election expenses and election contests; creating 5 and defining membership of county boards of elections; 6 imposing duties upon the Secretary of the Commonwealth, 7 courts, county boards of elections, county commissioners; 8 imposing penalties for violation of the act, and codifying, 9 revising and consolidating the laws relating thereto; and 10 repealing certain acts and parts of acts relating to 11 elections," FURTHER PROVIDING FOR FILING FEES; AND further <-- 12 providing for the time when specimen ballots are to be made 13 available. 14 The General Assembly of the Commonwealth of Pennsylvania 15 hereby enacts as follows: 16 SECTION 1. SECTION 913(B.1) OF THE ACT OF JUNE 3, 1937 <-- 17 (P.L.1333, NO.320), KNOWN AS THE PENNSYLVANIA ELECTION CODE, 18 AMENDED FEBRUARY 13, 1989 (P.L.1, NO.1), IS AMENDED TO READ: 19 SECTION 913. PLACE AND TIME OF FILING NOMINATION PETITIONS; 20 FILING FEES.--* * * 21 (B.1) EACH PERSON FILING ANY NOMINATION PETITION SHALL PAY 22 FOR EACH PETITION, AT THE TIME OF FILING, A FILING FEE TO BE
1 DETERMINED AS FOLLOWS, AND NO NOMINATION PETITION SHALL BE 2 ACCEPTED OR FILED, UNLESS AND UNTIL SUCH FILING FEE IS PAID BY A 3 CERTIFIED CHECK OR MONEY ORDER OR ALSO BY CASH WHEN FILED WITH 4 THE COUNTY BOARD. ALL MONEYS PAID ON ACCOUNT OF FILING FEES 5 SHALL BE TRANSMITTED BY THE COUNTY BOARD TO THE COUNTY TREASURER 6 AND SHALL BECOME PART OF THE GENERAL FUND. CERTIFIED CHECKS OR 7 MONEY ORDERS IN PAYMENT OF FILING FEES SHALL BE MADE PAYABLE TO 8 THE COMMONWEALTH OF PENNSYLVANIA OR TO THE COUNTY, AS THE CASE 9 MAY BE, AND SHALL BE TRANSMITTED TO THE STATE TREASURER OR TO 10 THE COUNTY TREASURER AND SHALL BECOME PART OF THE GENERAL FUND. 11 1. IF FOR THE OFFICE OF PRESIDENT OF THE UNITED STATES, OR 12 FOR ANY PUBLIC OFFICE TO BE FILLED BY THE ELECTORS OF THE STATE 13 AT LARGE, THE SUM OF TWO HUNDRED DOLLARS ($200.00). 14 2. IF FOR THE OFFICE OF REPRESENTATIVE IN CONGRESS, THE SUM 15 OF ONE HUNDRED FIFTY DOLLARS ($150.00). 16 3. IF FOR THE OFFICE OF JUDGE OF A COURT OF RECORD, 17 EXCEPTING JUDGES TO BE VOTED FOR BY THE ELECTORS OF THE STATE AT 18 LARGE, THE SUM OF ONE HUNDRED DOLLARS ($100.00). 19 4. IF FOR THE OFFICES OF SENATOR OR REPRESENTATIVE IN THE 20 GENERAL ASSEMBLY, FOR ANY OFFICE TO BE FILLED BY THE ELECTORS OF 21 AN ENTIRE COUNTY, FOR THE OFFICE OF DISTRICT COUNCILMAN IN A 22 CITY OF THE FIRST CLASS AND FOR ANY OFFICE OTHER THAN SCHOOL 23 DISTRICT OFFICE TO BE FILLED BY THE ELECTORS OF AN ENTIRE CITY 24 [OTHER THAN SCHOOL DISTRICT OFFICE], THE SUM OF ONE HUNDRED 25 DOLLARS ($100.00)[.], EXCEPT AS PROVIDED IN PARAGRAPH 4.1. 26 4.1. IF FOR NONSCHOOL BOARD OFFICES FOR ANY THIRD CLASS CITY 27 OFFICIAL, THE SUM OF TWENTY-FIVE DOLLARS ($25.00). 28 5. IF FOR ANY BOROUGH, TOWN, OR TOWNSHIP OF THE FIRST CLASS, 29 NOT OTHERWISE PROVIDED FOR, THE SUM OF FIVE DOLLARS ($5.00). 30 6. 1 NATIONAL PARTY CONVENTION, OR MEMBER OF NATIONAL COMMITTEE OR 2 MEMBER OF STATE COMMITTEE, THE SUM OF TWENTY-FIVE DOLLARS 3 ($25.00). 4 7. IF FOR THE OFFICE OF CONSTABLE, THE SUM OF TEN DOLLARS 5 ($10.00). 6 8. IF FOR THE OFFICE OF DISTRICT COUNCILMAN IN A CITY OF THE 7 SECOND CLASS OR THE OFFICE OF DISTRICT JUSTICE, THE SUM OF FIFTY 8 DOLLARS ($50.00). 9 * * * 10 Section 1 2. Section 1008 of the act of June 3, 1937 <-- 11 (P.L.1333, No.320), known as the Pennsylvania Election Code, is 12 amended to read: 13 Section 1008. Forms of Ballots on File and Open to Public 14 Inspection; Ballots and Diagrams to Be Furnished to Candidates 15 and Parties.-- 16 (a) The county board of elections shall have on file in its 17 office, on and after the [Thursday] twentieth (20th) day 18 preceding each primary and election, open to public inspection, 19 forms of the ballots and ballot labels, with the names and such 20 statements and notations as may be required by the provisions of 21 this act, printed thereon, which shall be used in each election 22 district within the county. 23 (b) On [the Thursday] and after the twentieth (20th) day 24 preceding each primary, the county board shall, upon request 25 made at their office, there deliver to each candidate whose name 26 is printed on the ballot of any party, or to his authorized 27 representative, without charge, three specimen ballots of such 28 party for the entire district in which such candidate is to be 29 voted for, and the candidate may, at his own expense, have 30 printed on different colored paper as many copies as he requires 19890H1604B3549 - 3 -
1 for conducting his campaign. 2 (c) On [the Thursday] and after the twentieth (20th) day 3 preceding each November election, the county board shall, upon 4 request made at their office, there deliver to the county 5 chairman or other authorized representative of each political 6 party and political body in the county, without charge, two 7 specimen ballots or diagrams for each election district within 8 the county in which candidates of such party or political body 9 are to be voted for, and such political party or political body 10 may, at its own expense, have printed on different colored paper 11 as many copies as it requires for conducting its campaign. 12 Section 2 3.
