AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," further providing for 4 persons eligible for medical assistance. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 441.1 of the act of June 13, 1967 8 (P.L.31, No.21), known as the Public Welfare Code, added July 9 31, 1968 (P.L.904, No.273), is amended to read: 10 Section 441.1. Persons Eligible for Medical Assistance.--The 11 following persons shall be eligible for medical assistance: 12 (1) Persons who receive or are eligible to receive cash 13 assistance grants under this article; 14 (2) Persons who meet the eligibility requirements of this 15 article for cash assistance grants except for citizenship, 16 durational residence and any eligibility condition or other 17 requirement for cash assistance which is prohibited under Title
1 XIX of the Federal Social Security Act; [and] 2 (3) The medically needy[.]; and 3 (4) Children under five years of age and pregnant women 4 whose income is one hundred fifteen percent of the federally- 5 determined poverty level for the fiscal year 1989-1990; children 6 under six years of age and pregnant women whose family income is 7 at or less than one hundred twenty-five percent of the 8 federally-determined poverty level for the fiscal year 1990- 9 1991; children under seven years of age and pregnant women whose 10 family income is at or less than one hundred fifty percent of 11 the federally-determined poverty level for the fiscal year 1991- 12 1992, and children under eight years of age and pregnant women 13 whose family income is at or less than one hundred eighty-five 14 percent of the federally-determined poverty level for the fiscal 15 year 1992-1993, consistent with the provisions of Federal law 16 relating to the medical assistance program. For the purpose of 17 this section, these recipients shall be entitled to the medical 18 assistance benefits available to persons deemed categorically 19 needy as provided for in clause (1), consistent with services 20 eligible for Federal financial participation. 21 Section 2.
