AN ACT
1 Amending Title 71 (State Government) of the Pennsylvania
2 Consolidated Statutes, further providing for eligibility for
3 annuities.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5308(c) of Title 71 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5308. Eligibility for annuities.

10 (c) Disability annuity.--An active member or inactive member
11 on leave without pay who has credit for at least five years of
12 service or any active member or inactive member on leave without
13 pay who is an officer of the Pennsylvania State Police, an
14 enforcement officer or investigator of the Office of Attorney
15 General or an enforcement officer shall, upon compliance with
16 section 5907(k) be entitled to a disability annuity if prior to
17 attainment of superannuation age he becomes mentally or
18 physically incapable of continuing to perform the duties for
1 which he is employed and qualifies in accordance with the
2 provisions of section 5905(c)(1) (relating to duties of the
3 board regarding applications and elections of members).
4 Section 2. This act shall take effect in 60 days.
