                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for all-terrain vehicles.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The definition of "all-terrain vehicle" or "ATV"
     6  in section 7702 of Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended to read:
     8  § 7702.  Definitions.
     9     The following words and phrases when used in this chapter
    10  shall have, unless the context clearly indicates otherwise, the
    11  meanings given to them in this section:
    12     "All-terrain vehicle" or "ATV."
    13         (1)  A motorized off-highway vehicle, 50 inches or less
    14     in width, having a dry weight of 600 pounds or less,
    15     traveling on three or more low-pressure tires and having a
    16     seat designed to be straddled by the operator is designated
    17     as a Class I all-terrain vehicle.


     1         (2)  A motorized off-highway vehicle, 58 inches or less
     2     in width, having a dry weight of 700 pounds or less,
     3     traveling on four or more low-profile, low-pressure tires and
     4     having a bench seat is designated as a Class II all-terrain
     5     vehicle.
     6         (3)  A motorcycle designed for off-road travel.
     7         [(3)] (4)  This term does not include snowmobiles, [trail
     8     bikes,] motorboats, golf carts, aircraft, dune buggies,
     9     automobiles, construction machines, trucks or home utility
    10     machines; military, fire, emergency and law enforcement
    11     vehicles; implements of husbandry; multipurpose agricultural
    12     vehicles; vehicles used by the department; or off-road
    13     vehicles not generally used for outdoor recreation.

    15     Section 2.  This act shall take effect in 60 days.
