                                     AN ACT

     1  Amending the act of December 1, 1977 (P.L.249, No.83), entitled
     2     "An act prohibiting employers from firing employees who lose
     3     time from employment in the line of duty as volunteer
     4     firemen, fire police and volunteer members of ambulance
     5     services and rescue squads; and providing penalties," further
     6     expanding the definition of employer.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 4 of the act of December 1, 1977
    10  (P.L.249, No.83), entitled "An act prohibiting employers from
    11  firing employees who lose time from employment in the line of
    12  duty as volunteer firemen, fire police and volunteer members of
    13  ambulance services and rescue squads; and providing penalties,"
    14  amended December 5, 1988 (P.L.1102, No.131), is amended to read:
    15     Section 4.  As used in this act, "line of duty" shall mean

     1  going to, coming from or during fire prevention and safety
     2  activities which includes fire prevention, first aid, rescue and
     3  salvage, ambulance service, fire police work, assistance at
     4  accidents, control of crowds both on the fire grounds and at
     5  occasions of public or general assembly, animal rescue,
     6  abatement of conditions due to storm, flood or general peril,
     7  abatement or removal of hazards to safety and such other
     8  activities as are commonly undertaken by fire companies,
     9  ambulance services or rescue squads or their affiliated
    10  organizations. The term "employer" includes the Commonwealth,
    11  political subdivision, any individual, partnership, association,
    12  corporation, business trust, or any person or group of persons
    13  acting directly or indirectly in the interest of an employer in
    14  relation to any employee. The term "discipline" shall mean the
    15  taking of any action against an employee which adversely affects
    16  his regular pay to an extent greater than permitted by section
    17  2, his job status or opportunity for promotion, or his right to
    18  any benefit granted by the employer to other similarly situated
    19  employees.
    20     Section 2.  This act shall take effect immediately.
