                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for the
     4     regulation of caregivers caring for children.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 1074 and 1076 of the act of June 13,
     8  1967 (P.L.31, No.21), known as the Public Welfare Code, added
     9  December 5, 1980 (P.L.1112, No.193), are amended to read:
    10     Section 1074.  Visitation and Inspection.--The department or
    11  authorized agent of the department shall have the right to
    12  enter, visit and inspect on a random sample basis, upon
    13  complaint, or upon request of the caregiver, any family day care
    14  home registered or requiring registration under this article or
    15  any other premises in which a caregiver is caring for two to six
    16  children who are not relatives of the caregiver and shall have
    17  free and full access to the premises, where children are cared


     1  for, all records of the premises which relate to the children's
     2  care, and to the children cared for therein and full opportunity
     3  to speak with or observe such children.
     4     Section 1076.  Regulations.--The department is hereby
     5  authorized and empowered to adopt regulations establishing
     6  minimum and reasonable standards for the operation of family day
     7  care homes and the issuance of registration certificates. These
     8  regulations will establish the minimum standards of safety and
     9  care which will be required in family day care homes and will
    10  recognize the vital role which parents and guardians play in
    11  monitoring the care provided in family day care homes. The
    12  department is also authorized and empowered to adopt regulations
    13  establishing minimum standards of safety and care for any other
    14  premises in which a caregiver is caring for two to six children
    15  who are not relatives of the caregiver. The regulations shall
    16  include, but not be limited to, the following requirements:
    17     (1)  There shall be an operable smoke detector in the kitchen
    18  and on each building level used by the children.
    19     (2)  A portable fire extinguisher suitable for Class B fires
    20  shall be provided in the kitchen area and other cooking areas.
    21     Section 2.  This act shall take effect in 60 days.
