                                     AN ACT

     1  Amending the act of August 7, 1963 (P.L.549, No.290), entitled,
     2     as amended, "An act creating the Pennsylvania Higher
     3     Education Assistance Agency; defining its powers and duties;
     4     conferring powers and imposing duties on the Governor,
     5     President Pro Tempore of the Senate, Speaker of the House of
     6     Representatives, Superintendent of Public Instruction and the
     7     Department of Auditor General; and making appropriations,"
     8     authorizing loan forgiveness for certain nurses.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of August 7, 1963 (P.L.549, No.290),
    12  referred to as the Pennsylvania Higher Education Assistance
    13  Agency Act, is amended by adding a section to read:
    14     Section 4.4.  Loan Forgiveness.--(a)  Pursuant to section
    15  4(1.1)(iii), the board shall adopt a policy of and appropriate
    16  procedures for granting forgiveness for loan recipients who
    17  graduate from agency-approved institutions in agency-approved
    18  nursing programs, who are properly licensed pursuant to the act
    19  of May 22, 1951 (P.L.317, No.69), known as "The Professional

     1  Nursing Law," and who are employed as nurses in hospitals,
     2  nursing homes or other institutions or agencies providing
     3  medical services in this Commonwealth.
     4     (b)  For each calendar year that a nurse is employed as
     5  provided in subsection (a), twenty-five percent (25%) of the
     6  approved indebtedness shall be forgiven. Payment shall be made
     7  in accordance with the procedure established by the agency.
     8     (c)  The board of directors of the agency shall have the
     9  power and its duty shall be to adopt rules and regulations
    10  pursuant to the act of July 31, 1968 (P.L.769, No.240), referred
    11  to as the Commonwealth Documents Law, and not inconsistent with
    12  law governing matters relating to this section. The rules and
    13  regulations shall include the types of institutions providing
    14  medical services at which employment will qualify nurses for
    15  loan forgiveness and the manner of verification of employment.
    16     Section 2.  This act shall apply to loan recipients who
    17  graduate from agency-approved institutions in agency-approved
    18  nursing programs on or after January 1, 1989.
    19     Section 3.  This act shall take effect immediately.
