        INTRODUCED BY PETRONE, BELFANTI, FOX, VAN HORNE, KOSINSKI, VEON,
           PISTELLA, LAUGHLIN, TRELLO, GIGLIOTTI, SAURMAN, HERMAN,
           CAWLEY, LASHINGER, MELIO, J. L. WRIGHT, CORNELL, DALEY,
           REBER, OLIVER, OLASZ, GEIST AND HOWLETT, FEBRUARY 15, 1989

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JUNE 20, 1989

                                     AN ACT

     1  Providing for reductions in automobile insurance rates for motor
     2     vehicles equipped with antitheft devices or passive restraint
     3     systems; AND PROVIDING FOR GOOD-DRIVING INSURANCE RATINGS FOR  <--
     4     CERTAIN INSUREDS.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Definitions.
     8     The following words and phrases when used in this act shall
     9  have the meanings given to them in this section unless the
    10  context clearly indicates otherwise:
    11     "Department."  The Insurance Department of the Commonwealth.
    12     "Passive antitheft device."  Any item or system installed in
    13  an automobile to prevent unauthorized use which is activated
    14  automatically or which requires no action of the vehicle's
    15  occupants as prescribed by rules and regulations of the
    16  Insurance Department.
    17     "Passive restraint."  Any frontal automotive crash protection


     1  system which requires no action of the vehicle occupants and
     2  which complies with Standard 571.208 of the National Traffic
     3  Safety Administration.
     4  Section 2.  Antitheft devices.
     5     All insurance companies authorized to write private passenger
     6  automobile insurance within this Commonwealth shall reduce by     <--
     7  10% the approved rate, AS PART OF THEIR INSURANCE FILING,         <--
     8  PROVIDE PREMIUM DISCOUNT OF AT LEAST 10% in comprehensive
     9  coverage for all insured vehicles equipped with passive
    10  antitheft devices, INCLUDING VEHICLES THAT HAVE AN                <--
    11  IDENTIFICATION NUMBER PERMANENTLY ETCHED ON THE FRONT WINDSHIELD
    12  AND WINDOWS OF THE VEHICLE PURSUANT TO AN ETCHING PROGRAM
    13  ESTABLISHED BY THE DEPARTMENT OF TRANSPORTATION.
    14  Section 3.  Restraint systems.
    15     All insurance companies authorized to write private passenger
    16  automobile insurance within this Commonwealth shall reduce by     <--
    17  20% the approved rate, AS PART OF THEIR INSURANCE FILING,         <--
    18  PROVIDE PREMIUM DISCOUNT FOR A PASSIVE RESTRAINT WHICH SHALL
    19  INCLUDE A 15% DISCOUNT FOR PASSIVE SEAT BELTS, 20% FOR ONE AIR
    20  BAG ON THE OPERATOR'S SIDE OF THE VEHICLE AND 30% FOR TWO AIR
    21  BAGS for first-party medical benefits, as defined in 75 Pa.C.S.
    22  § 1712 (relating to availability of benefits), for any insured
    23  vehicle equipped with a passive restraint system for front seat
    24  passengers.
    25  SECTION 4.  GOOD-DRIVING INSURANCE RATING.                        <--
    26     AN INSURER SHALL GIVE A GOOD-DRIVING INSURANCE RATING AND A
    27  10% OVERALL PREMIUM RATE DISCOUNT TO ANY INSURED WHO HAS HELD AN
    28  OPERATOR'S LICENSE FOR A CONTINUOUS FOUR-YEAR PERIOD WITH NO
    29  POINTS ASSESSED UNDER 75 PA.C.S. § 1535 (RELATING TO SCHEDULE OF
    30  CONVICTIONS AND POINTS) AND WITH NO ACCIDENTS FOR WHICH AN

     1  INSURER WAS OBLIGATED TO MAKE A PAYMENT. THE GOOD-DRIVING
     2  INSURANCE RATING REQUIRED UNDER THIS SECTION SHALL BE THE SAME
     3  FOR ALL INSUREDS, WITHOUT REGARD TO AGE, SEX, ETHNIC BACKGROUND,
     4  DISABILITY, RACE, COLOR OR RELIGIOUS CREED.
     5  Section 4 5.  Effective date.                                     <--
     6     This act shall take effect immediately.
