AN ACT
1 Amending the act of July 22, 1974 (P.L.589, No.205), entitled
2 "An act relating to unfair insurance practices; prohibiting
3 unfair methods of competition and unfair or deceptive acts
4 and practices; and prescribing remedies and penalties,"
5 further prohibiting unfair practices relating to certain
6 adopted disabled minor children.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of July 22, 1974 (P.L.589, No.205), known
10 as the Unfair Insurance Practices Act, is amended by adding a
11 section to read:
12 Section 5.1. Adopted Children with Special Needs.--(a) It
13 shall be an unfair insurance practice and a violation of this
14 act for the health care insurer of a person or family to exclude
15 from coverage or reduce the amount of coverage of health
16 insurance for any adopted disabled minor child of that person or
17 family, or of any disabled minor child subject to pending
18 adoption proceedings initiated by that person or family.
19 (b) As used in this section, "disabled minor child" shall
1 mean a minor child with a physical, mental or emotional
2 disability.
3 Section 2. This act shall take effect in 60 days.
