           KUKOVICH, COWELL, RYBAK, KOSINSKI, SALOOM, REBER, BUNT,
           BILLOW, FOX, RICHARDSON, JOHNSON, HALUSKA, VEON, CORNELL,
           VAN HORNE, BISHOP, MELIO, GIGLIOTTI AND LAUGHLIN,

                                     AN ACT

     1  Amending the act of February 11, 1976 (P.L.14, No.10), entitled
     2     "An act authorizing development of rural and intercity common
     3     carrier surface transportation," further providing for grants
     4     for transportation; and making an editorial change.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 4(3.1) of the act of February 11, 1976
     8  (P.L.14, No.10), known as the Pennsylvania Rural and Intercity
     9  Common Carrier Surface Transportation Assistance Act, added
    10  October 17, 1980 (P.L.1083, No.183), is amended to read:
    11     Section 4.  Program Authorizations.--The department is hereby
    12  authorized, within the limitations hereinafter provided:
    13     * * *
    14     (3.1)  To make grants from the State Lottery Fund to
    15  transportation companies, county transportation systems and
    16  local transportation organizations to pay estimated transit
    17  losses resulting from providing:


     1     (i)  Free service [or] on local common carrier mass
     2  transportation systems to persons 65 years or older when such
     3  passage is on fixed route public transportation services during
     4  [nonpeak riding hours and on] all hours of operation, including
     5  holidays and weekends. The losses resulting from granting
     6  service on mass transportation systems shall be reimbursable at
     7  75% of such system's average fare multiplied by the number of
     8  trips made by senior citizens participating in such free transit
     9  program. Transit systems that currently receive a program
    10  reimbursement based upon a percentage of average fare greater
    11  than 75% shall receive their current amount of senior citizen
    12  program reimbursement until such time as the amount of
    13  reimbursement for these systems equals 75% of the average fare
    14  times the number of senior citizens trips: Provided, however,
    15  That reimbursement for the fiscal year 1980-1981 shall be
    16  calculated using the average fares as of January 1, 1980.
    17     (ii)  Free or reduced fare on shared ride county
    18  transportation systems for persons 65 years or older:
    19     (A)  In case of free service on such county systems, the
    20  county shall be reimbursed at 75% of the cost incurred or to be
    21  incurred in operating and maintaining such system, with the
    22  remainder of any such cost being paid by the county.
    23     (B)  In case of reduced fare services on such county systems,
    24  the county shall be reimbursed at the same rate and under the
    25  same conditions as provided in subparagraph (iii).
    26     (iii)  Reduced fare services on local common carrier mass
    27  transportation systems to persons 65 years of age or older when
    28  such passage is on shared ride public or contract transportation
    29  services during regular hours of operation. On shared public
    30  transportation, losses are reimbursable only if the elderly

     1  person pays 25¢ or 25% of the cost of the individual fare,
     2  whichever is greater.
     3     (iv)  In no case shall the reimbursements for each succeeding
     4  year exceed the prior year's reimbursements increased by a
     5  percentage equal to the percentage increase in granting costs
     6  for all local transportation organizations, county
     7  transportation systems and transportation companies for the most
     8  recently completed State fiscal year as compared to the fiscal
     9  year immediately preceding such year.
    10     (v)  The department shall promulgate such rules and
    11  regulations as are necessary to carry out the purposes of this
    12  subparagraph. In accordance with section 2203-A(27) of the act
    13  of April 9, 1929 (P.L.177, No.175), known as "The Administrative
    14  Code of 1929," no such regulation shall take effect until they
    15  are submitted to the Department of Aging for comment.
