                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     reimbursement for certain dental services.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 443.6(b) of the act of June 13, 1967
     8  (P.L.31, No.21), known as the Public Welfare Code, added
     9  September 26, 1978 (P.L.769, No.146), is amended to read:
    10     Section 443.6.  Reimbursement for Certain Medical Assistance
    11  Items and Services.--* * *
    12     (b)  Payment for the following medical assistance items and
    13  services shall be made only after prior authorization has been
    14  secured:
    15     (1)  Prostheses and orthoses.
    16     (2)  Purchase of appliances or equipment if the appliance or
    17  equipment costs more than one hundred dollars ($100).

     1     (3)  Rental of medical appliances or equipment for a period
     2  in excess of three months.
     3     (4)  Oxygen and related equipment in the home unless a
     4  physician states that the physical surroundings in the home are
     5  suitable for the use of oxygen and that the recipient is
     6  adequately prepared and able to use the equipment.
     7     (5)  Dental services as the department may provide, including
     8  but not [necessarily] limited to, dental prostheses and
     9  appliances, extractions related to dental prostheses and
    10  appliances, [and] other extractions as may be provided by
    11  department regulations, examinations and preventive dental care.
    12  Fees for dental services shall be no less than seventy-five
    13  percent of the Statewide average for usual and customary
    14  charges. The fee shall be adjusted annually.
    15     (6)  Orthopedic shoes or other supportive devices for the
    16  feet when such shoes or devices are prescribed by a physician
    17  for the purpose of correcting or otherwise treating
    18  abnormalities of the feet or legs which cause serious
    19  detrimental medical effects.

    21     Section 2.  This act shall take effect in 60 days.
