AS AMENDED ON SECOND CONSIDERATION, APRIL 6, 1987
AN ACT 1 Amending the act of February 1, 1966 (1965 P.L.1656, No.581), 2 entitled "An act concerning boroughs, and revising, amending 3 and consolidating the law relating to boroughs," further 4 providing for expenses of delegates and mayors incurred in 5 attending meetings and conventions. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 701 of the act of February 1, 1966 (1965 9 P.L.1656, No.581), known as The Borough Code, amended May 16, 10 1985 (P.L.35, No.17), is amended to read: 11 Section 701. State Association of Boroughs.--The boroughs of 12 the Commonwealth are authorized to organize a State Association 13 of Boroughs for the purpose of advancing the interests of the 14 boroughs. Any borough may join the said association by motion of 15 council and payment of the annual dues. Council may designate 16 one or more delegates from the elected or appointed officials of 17 the borough to attend the annual meeting of the association, 18 which shall be held in the Commonwealth in accordance with the 19 procedure adopted by the association. In addition to any
1 compensation allowed by law each delegate may be allowed for his 2 expenses incurred in attending the meeting [an amount not 3 exceeding ninety dollars ($90) per day], the actual expenses 4 incurred for lodging plus twenty-five dollars ($25) PER DAY for <-- 5 meals, gratuities and other expenses, together with mileage 6 going to and returning from the meeting. In addition, the 7 registration or similar fee incurred in connection with 8 attending the annual meeting shall be an allowable expense. The 9 time spent in attending said meeting shall not be more than four 10 days, including the time employed in traveling thereto and 11 therefrom. Each borough, becoming a member of the association, 12 shall pay such reasonable dues as may be fixed by the 13 association. 14 The dues and other revenues received by the association shall 15 be used to pay for services, publications and other expenses 16 authorized or ratified by the association, or incurred in behalf 17 of the association, by its officers and committees. 18 Section 2. Section 703 of the act is amended to read: 19 Section 703. Other Associations and Organizations.--Any 20 borough, by motion of council, may join other associations and 21 organizations concerned with municipal or governmental affairs; 22 may pay dues to and appropriate moneys for the support of and 23 participation in such associations and organizations; and may 24 send delegates to meetings or conventions of such associations 25 and organizations [and pay the necessary expenses incident to 26 their attendance at such meetings]. In addition to any 27 compensation allowed by law each delegate may be allowed for his 28 expenses incurred in attending a meeting or convention, the 29 actual expenses incurred for lodging plus twenty-five dollars 30 ($25) PER DAY for meals, gratuities and other expenses, together <-- 19870S0564B0798 - 2 -
1 with mileage going to and returning from the meeting or 2 convention. In addition, the registration or similar fee 3 incurred in connection with attending the meeting or convention 4 shall be an allowable expense. The time spent in attending the 5 meeting or convention shall not be more than four days, 6 including the time employed in traveling thereto and therefrom. 7 Any borough, by motion of council, may authorize any of its 8 officers and/or employes to attend meetings of professional 9 organizations and associations, or study or training sessions 10 for persons holding the same or similar office or employment, 11 and may pay all or any specified portion of the necessary 12 expenses incident to their attendance at such meetings or 13 sessions. 14 Every person attending any convention, meeting or study or 15 training session referred to in this section shall submit to the 16 council an itemized account of his expenses thereat, including 17 traveling expenses or mileage, that council may have agreed to 18 pay. 19 Section 3. Section 704 of the act, amended May 16, 1985 20 (P.L.35, No.17), is amended to read: 21 Section 704. Associations and Organizations for Mayors.--Any 22 mayor may join a mayors' association and borough council shall 23 pay reasonable dues, not to exceed twenty-five dollars ($25), as 24 may be fixed by the association for each mayor belonging to that 25 association. The mayor may attend the annual meeting of the 26 association, which shall be held in the Commonwealth in 27 accordance with the procedure adopted by the association. Each 28 mayor shall be allowed for expenses incurred in attending the 29 meeting an amount not exceeding ninety dollars ($90) per day, 30 together with mileage, at the rate otherwise provided by law, in 19870S0564B0798 - 3 -
1 going to and returning from the meeting. In addition, the 2 registration or similar fee incurred in connection with 3 attending the annual meeting shall be an allowable expense. The 4 time spent in attending said meeting shall not be more than four 5 days, including time in traveling to and from the meeting. 6 Section 4. This act shall take effect immediately.
