                                     AN ACT

     1  Amending the act of June 5, 1968 (P.L.140, No.78), entitled "An
     2     act regulating the writing, cancellation of or refusal to
     3     renew policies of automobile insurance; and imposing powers
     4     and duties on the Insurance Commissioner therefor,"
     5     regulating insurance cancellation for multiple person
     6     policies.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 3 of the act of June 5, 1968 (P.L.140,
    10  No.78), entitled "An act regulating the writing, cancellation of
    11  or refusal to renew policies of automobile insurance; and
    12  imposing powers and duties on the Insurance Commissioner
    13  therefor," is amended by adding a subsection to read:
    14     Section 3.  * * *
    15     (i)  In any case where the conditions of this section are
    16  satisfied for a policy insuring more than one person and the
    17  insurer is authorized to cancel or refuse to write or renew the
    18  policy because of the claim experience or driving record of one
    19  or more, but less than all, of the persons insured under the


     1  policy:
     2     (1)  The insurer shall, in lieu of cancellation or refusal to
     3  write or renew, offer to exclude all coverages when a motor
     4  vehicle is operated by the specifically named excluded person or
     5  persons whose claim experience or driving record justifies
     6  action under this section.
     7     (2)  When the policy is endorsed to specifically exclude all
     8  coverages when the named excluded driver is operating the motor
     9  vehicle covered under the policy, this exclusion applies whether
    10  or not that operation or use was with the express or implied
    11  permission of a person insured under the policy.
    12     Section 2.  This act shall take effect in 60 days.
