                                     AN ACT

     1  Authorizing the release of Project 70 restrictions imposed on
     2     certain lands owned by the Borough of Freemansburg,
     3     Northampton County, in return for the imposition of Project
     4     70 restrictions on certain lands in Freemansburg, Northampton
     5     County, to be conveyed by Richard C. Goodwin, to the Borough
     6     of Freemansburg.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9  Section 1.  Authorization.
    10     Pursuant to the requirements of section 20(b) of the act of
    11  June 22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70
    12  Land Acquisition and Borrowing Act, the General Assembly hereby
    13  authorizes the release of the restrictions imposed by section 20
    14  of the Project 70 Land Acquisition and Borrowing Act from the
    15  lands owned by the Borough of Freemansburg, Northampton County,
    16  and more particularly described in section 3 in exchange for the
    17  imposition of the section 20 restrictions on lands owned by
    18  Richard C. Goodwin, and more particularly described in section
    19  4.


     1  Section 2.  Freedom of restrictions.
     2     The lands described in section 3 and owned by the Borough of
     3  Freemansburg shall be free of the restrictions on use and
     4  alienation imposed by section 20 of the act of June 22, 1964
     5  (Sp.Sess., P.L.131, No.8), known as the Project 70 Land
     6  Acquisition and Borrowing Act, upon the imposition of and
     7  recording of the Project 70 deed restrictions set forth in
     8  section 5 on the parcel of replacement land owned by Richard C.
     9  Goodwin, described in section 4.
    10  Section 3.  Land to be free from restrictions.
    11     The parcel of land authorized to be released from
    12  restrictions is located in the Borough of Freemansburg and more
    13  particularly described as follows:
    14     Beginning at the intersection of the easterly street line of
    15  Cambria Street, a street fifty (50) feet in width, with the
    16  southerly street line of Washington Street, a street fifty-five
    17  (55) feet in width; thence, along said southerly street line of
    18  Washington Street, the following two (2) courses and distances:
    19  (1) by an arc to the right the radius of which is one thousand
    20  eight hundred eighty-two and fifty-eight one-hundredths
    21  (1882.58) feet and the chord of which bears South eighty-two
    22  degrees twenty-four minutes five seconds East (S. 82 degrees 24
    23  minutes 05 seconds E.) one hundred seventy-nine and twenty-two
    24  one-hundredths (179.22) feet, an arc distance of one hundred
    25  seventy-nine and twenty-nine one hundredths (179.29) feet to a
    26  point; and (2) South seventy-nine degrees forty minutes twenty-
    27  three seconds East (S. 79 degrees 40 minutes 23 seconds E.)
    28  seven hundred seventy-seven and seventy-nine one-hundredths
    29  (777.79) feet to a boat spike; thence, leaving the
    30  aforementioned street line of Washington Street, partly along

     1  land now or formerly of P. Pocyak and partly along land now or
     2  formerly of O. S. Frye, South one degree fourteen minutes
     3  twenty-three seconds East (S. 1 degrees 14 minutes 23 seconds
     4  E.) three hundred sixty-one and seventy-nine one-hundredths
     5  (361.79) feet to a boat spike; thence, partly along land of
     6  Freemansburg School District and party along land of the Grantor
     7  herein, South eighty-nine degrees forty-five minutes twenty-five
     8  seconds West (S. 89 degrees 45 minutes 25 seconds W.) nine
     9  hundred forty-nine and eighty-nine one-hundredths (949.89) feet
    10  to a boat spike in the aforementioned easterly street line of
    11  Cambria Street; thence, along said easterly street line of
    12  Cambria Street, North no degrees five minutes eight seconds West
    13  (N. 0 degrees 05 minutes 08 seconds W.) five hundred twenty-
    14  eight and eighty-seven one-hundredths (528.87) feet to the point
    15  of beginning; CONTAINING nine and seven hundred forty-eight one-
    16  thousandths (9.748) acres, more or less.
    17  Section 4.  Land on which restrictions are to be imposed.
    18     The replacement parcels to be subject to restrictions in
    19  exchange for the parcel described in section 3 is located in the
    20  Borough of Freemansburg and more particularly described as
    21  follows:
    22     Tract 1 (lot No.151) Beginning at a point on the eastern
    23  right-of-way on Cambria Street, said point being 541.16 feet
    24  north of the intersection of Cambria Street and Market Street,
    25  and 25 feet east of the center line of Cambria Street, thence
    26  north 89 degrees 45 minutes east a distance of 139.65 feet to a
    27  point, thence south 0 degrees 38 minutes 26 seconds east a
    28  distance of 280.26 feet to a point, thence south 89 degrees 45
    29  minutes 0 seconds west a distance of 114.89 feet to a point,
    30  thence along a northwest curve on the northeastern corner of

     1  Lincoln Way and Cambria Street said curve having a radius of 25
     2  feet and a length of 139.11 feet to a point, thence north 0
     3  degrees 37 minutes 30 seconds west a distance of 255.42 feet to
     4  the point and place of beginning. Containing 39,017 square feet
     5  more or less and also known at lot No.151 on Plan P-2942-1 from
     6  Goodwin Enterprises Market Square development.
     7     Tract 2 (lot No.152) Beginning at a point on the northeastern
     8  corner of the intersection of Market Street and Cambria Street
     9  said point being located 35 feet northeast of the center line of
    10  said intersection, thence the following courses and distances:
    11  south 86 degrees 9 minutes 30 seconds east a distance of 14.72
    12  feet, thence along a curve bearing to the southeast having a
    13  radius of 242.05 feet and a length of 135.33 feet to a point,
    14  thence north 0 degrees 38 minutes 26 seconds west a distance of
    15  234.76 feet to a point; thence south 89 degrees 45 minutes 0
    16  seconds west, a distance of 114.58 feet to a point; thence along
    17  a southwesterly curve along the southern side of Lincoln Way
    18  having a radius of 25 feet and a length of 39.11 feet to a
    19  point; thence south 0 degrees 37 minutes 30 seconds east a
    20  distance of 162.62 feet to the point and place of beginning.
    21  Containing 28,281 square feet of land more or less and also
    22  known as lot No.152 on Plan P-2942-1 for Goodwin Enterprises
    23  Market Square development.
    24     Tract 3 (lot No.5) Beginning at an iron pin located on the
    25  southern boundary of Monroe Street 207.94 feet east of the
    26  intersection of Monroe Street and Linden Street thence north 89
    27  degrees 45 minutes 0 seconds east, a distance of 70.00 feet to
    28  an iron pin; thence south 0 degrees 15 minutes 0 seconds east a
    29  distance of 230.00 feet to a point; thence south 89 degrees 45
    30  minutes 0 seconds west, a distance of 99.93 feet; thence south

     1  50 degrees 9 minutes 45 seconds west to a point, a distance of
     2  52 feet; thence northwesterly along the curve of the cul-de-sac
     3  of Linden Court a distance of 12.55 feet to a point; thence
     4  north 35 degrees 46 minutes 55 seconds east, a distance of 52
     5  feet to a point; thence north 0 degrees 15 minutes 0 seconds
     6  west, a distance of 92.51 feet to a point; thence north 89
     7  degrees 45 minutes 0 seconds east a distance of 47.94 feet to a
     8  point; thence north 0 degrees 15 minutes 0 seconds west, a
     9  distance of 120 feet to the point and place of beginning,
    10  containing 22,189 square feet more or less and also known as lot
    11  No.5 on Plan P-2942-1 for Goodwin Enterprises Market Square
    12  development.
    13  Section 5.  Description of deed restrictions.
    14     The deed restriction to be transferred to the parcel
    15  described in section 4 shall read as follows:
    16     This indenture is given to provide land for recreation,
    17  conservation and historical purposes as said purposes are
    18  defined in the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
    19  known as the Project 70 Land Acquisition and Borrowing Act.
    20  Section 6.  Effective date.
    21     This act shall take effect immediately.
