                                     AN ACT

     1  Amending the act of December 29, 1972 (P.L.1713, No.367),
     2     entitled "An act concerning motor vehicle physical damage
     3     appraisers; providing for the licensing of persons engaged in
     4     appraising physical damages to motor vehicles; fixing fees
     5     and prescribing unlawful acts and penalties," imposing
     6     limitations on estimates of repair costs based on certain
     7     replacement parts.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of December 29, 1972 (P.L.1713, No.367),
    11  known as the Motor Vehicle Physical Damage Appraiser Act, is
    12  amended by adding a section to read:
    13     Section 11.1.  Restrictions on Use of Certain Replacement
    14  Parts.--(a)  Notwithstanding the provisions of section 11(b), it
    15  shall be a violation of this act for any appraiser or an
    16  employer of any appraiser to prepare or require to be prepared
    17  any appraisal on the repair of damages to a motor vehicle based
    18  on the use of replacement parts which fail to meet or exceed the
    19  standards of the original manufacturer of the motor vehicle or
    20  the Federal Department of Transportation, which standards are

     1  more stringent.
     2     (b)  As used in this section, the following words and phrases
     3  shall have the meanings given to them in this subsection:
     4     "Original manufacturer" means the manufacturer of the motor
     5  vehicle which has specifications and standards for the motor
     6  vehicle or each individual part used in such motor vehicle.
     7     "Replacement parts" means the structural, sheet metal, glass
     8  or plastic components which constitute the visible exterior of
     9  the vehicle, including inner and outer panels and other parts
    10  repaired or replaced as a result of a collision.
    11     Section 2.  This act shall take effect in 60 days.
