                                     AN ACT

     1  Amending the act of December 29, 1972 (P.L.1713, No.367),
     2     entitled "An act concerning motor vehicle physical damage
     3     appraisers; providing for the licensing of persons engaged in
     4     appraising physical damages to motor vehicles; fixing fees
     5     and prescribing unlawful acts and penalties," further
     6     regulating appraisals.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 11 of the act of December 29, 1972
    10  (P.L.1713, No.367), known as the Motor Vehicle Physical Damage
    11  Appraiser Act, is amended by adding a subsection to read:
    12     Section 11.  Compliance with Act.--* * *
    13     (h)  No appraiser or his employer shall require that a repair
    14  shop accept a maximum hourly labor rate determined by that
    15  appraiser or his employer, or on behalf of that appraiser or his
    16  employer, unless the hourly labor rate requested by the repair
    17  shop exceeds that of the majority of similar repair facilities
    18  in its geographic area by at least fifteen (15%) percent, or the
    19  appraisal is prepared for the vehicle owner's insurance carrier,


     1  and that owner's policy contains in bold and conspicuous
     2  language, a statement which provides as follows: "THIS POLICY
     3  SHALL COVER THE COST OF REPAIRS TO A VEHICLE INSURED HEREUNDER
     4  ONLY TO THE EXTENT THAT THOSE REPAIRS ARE NOT MADE AT AN HOURLY
     5  LABOR RATE WHICH EXCEEDS          ($     ) DOLLARS PER HOUR, OR
     6  SUCH HIGHER RATE WHICH MAY FROM TIME TO TIME BE AUTHORIZED."
     7     Section 2.  This act shall take effect in 60 days.
