           REPRESENTATIVES, AS AMENDED, JUNE 13, 1988

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor and the Department of
     3     Agriculture, to convey and confirm two tracts of land located
     4     in Penn Township, Snyder County, Pennsylvania, to Randall W.
     5     Bailey and Ellen S. Bailey, his wife, and Rick L. Bailey and
     6     Kathy A. Bailey, his wife.

     7     WHEREAS, The Department of General Services, in accordance
     8  with Act No. 48, approved by the Governor on July 1, 1981,
     9  received bids for the sale of six properties in Penn Township,
    10  Snyder County, on October 31, 1983, and consummated said sales
    11  in February and March of 1984 by delivery of officially executed
    12  deeds which were then recorded by the respective grantees; and
    13     WHEREAS, Two of the tracts which were sold and conveyed by
    14  the Commonwealth of Pennsylvania, particularly to Randall W.
    15  Bailey and Ellen S. Bailey, his wife, and Rick L. Bailey and
    16  Kathy A. Bailey, his wife, may be increased in size to conform
    17  to the subdivision requirements in Penn Township, Snyder County.
    18     The General Assembly of the Commonwealth of Pennsylvania
    19  hereby enacts as follows:

     1     Section 1.  The Department of General Services, with the
     2  approval of the Governor and the Department of Agriculture, is
     3  hereby authorized and directed, on behalf of the Commonwealth of
     4  Pennsylvania, to grant and convey, for a consideration equal to
     5  ONE-HALF OF the fair market value as determined by an             <--
     6  independent appraiser selected by the Department of General
     7  Services, to Randall W. Bailey and Ellen S. Bailey, his wife,
     8  and Rick L. Bailey and Kathy A. Bailey, his wife, the following
     9  described tracts of land and the buildings erected thereon:
    10     All those certain tracts of land both with the residence and
    11  improvements thereon, surveyed for the grantees herein, situate
    12  in Penn Township, Snyder County, Pennsylvania, bounded and
    13  described as follows:
    14                             Tract No.1
    15     Beginning at an iron pin on the western right-of-way line of
    16  Legislative Route 54043, said pin being located 16.52 feet
    17  westward from a P.K. nail located on the center line of
    18  Legislative Route 54043, said pin also being the southeast
    19  corner of the herein described tract of land; thence along
    20  remaining land of the Commonwealth, north 79 degrees 01 minute
    21  45 seconds west 190.40 feet to an iron pin; thence along the
    22  same north 10 degrees 18 minutes 48 seconds east 225.61 feet to
    23  an iron pin; thence along the same south 78 degrees 53 minutes
    24  40 seconds east 114.80 feet to an iron pin; thence along the
    25  same south 69 degrees 01 minute 45 seconds east 90.55 feet to an
    26  iron pin; thence along the western right-of-way line of
    27  Legislative Route 54043, south 13 degrees 58 minutes 15 seconds
    28  west 209.89 feet to the point of beginning.
    29     Containing 1.0062 acres, more or less.
    30     Being part of the premises which J.F. Good, by deed dated and

     1  recorded at Middleburg, in the Snyder County Recorder's Office
     2  in Deed Book 40, Page 1, granted and conveyed unto the
     3  Commonwealth of Pennsylvania, in fee.
     4                             Tract No.2
     5     Beginning at an iron pin on the western right-of-way line of
     6  State Route 204, said pin being located 25 feet more or less
     7  westward from the center line of State Route 204, said pin also
     8  being the northeast corner of the herein described tract of
     9  land; thence along the western right-of-way line of State Route
    10  204 on the arc of a circle curving to the right having a radius
    11  of 1120.92 feet the arc distance of 165.87 feet (subtended by a
    12  chord of south 15 degrees 46 minutes 26 seconds east 165.74
    13  feet) to an iron pin; thence along a designated line north of
    14  Hospital Road south 47 degrees 07 minutes 45 seconds west 115.72
    15  feet to an iron pin and a bend in said road; thence along said
    16  road south 38 degrees 01 minute 33 seconds west 100.49 feet to
    17  an iron pin; thence along remaining land of the Commonwealth
    18  north 29 degrees 34 minutes 16 seconds west 270.13 feet to an
    19  iron pin; thence along the same north 70 degrees 40 minutes 30
    20  seconds east 249.01 feet to the point of beginning.
    21     Containing 1.0956 acres, more or less.
    22     Being part of the premises which J.G. Ott, et ux by deed
    23  dated and recorded at Middleburg in the Snyder County Recorder's
    24  Office in Deed Book 52, Page 100, granted and conveyed unto the
    25  Commonwealth of Pennsylvania, in fee.
    26     Section 2.  The conveyance shall be made under and subject to
    27  all easements, servitudes and rights of others, including, but
    28  not confined to, streets, roadways and rights of telephone,
    29  telegraph, water, electric, sewer, gas or pipeline companies, as
    30  well as under and subject to any interest, estates or tenancies

     1  vested in third persons, whether or not appearing of record, for
     2  any portion of the land or improvements erected thereon.
     3     Section 3.  The deed of conveyance shall be approved as
     4  provided by law and shall be executed by the Secretary of
     5  General Services in the name of the Commonwealth of
     6  Pennsylvania.
     7     Section 4.  Costs and fees incidental to this conveyance
     8  shall be borne by the grantees.
     9     Section 5.  This act shall take effect immediately.
