AN ACT 1 Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An 2 act providing for safe drinking water; imposing powers and 3 duties on the Department of Environmental Resources in 4 relation thereto; and appropriating certain funds," further 5 providing for testing by the department. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Sections 8 and 9 of the act of May 1, 1984 9 (P.L.206, No.43), known as the Pennsylvania Safe Drinking Water 10 Act, are amended by adding subsections to read: 11 Section 8. Inspections and recordkeeping requirements. 12 (a) Department authorized to inspect, test, etc.--The 13 department is authorized to make inspections and conduct tests 14 or sampling, including the examination and copying of books, 15 papers, records and data, pertinent to any matter under 16 investigation in order to determine compliance with this act and 17 for this purpose, the duly authorized agents and employees of 18 the department are authorized at all reasonable times to enter 19 and examine any property, facility, operation or activity.
1 (b) Department authorized to establish recordkeeping 2 requirements.--The department and its agents are authorized to 3 require any supplier of water to establish and maintain such 4 records and make such reports and furnish such information as 5 the department may prescribe as being necessary to demonstrate 6 that the supplier is complying with the requirements of this act 7 and with the terms and conditions of its water supply permit. 8 (c) Required testing.--The department shall require all 9 public water suppliers to conduct giardiasis tests of each water 10 source which supplies water for public consumption not less than 11 once a month, unless a more frequent testing schedule is 12 determined to be necessary by the department. If any test 13 indicates positive results, the department shall require weekly 14 testing of the water source for a period not exceeding three 15 months. 16 Section 9. Laboratories. 17 (a) Department to establish standards of performance.--The 18 department shall establish standards of performance, by rule or 19 regulation, for laboratories and laboratory officers which 20 conduct analytical measurements for the purpose of ascertaining 21 compliance by public water systems, including bottled and bulk 22 water operations, with the requirements of this act. 23 (b) Items to be included in standards.--Such standards may 24 include, but are not limited to, equipment, laboratory 25 procedures, standards for analytical methods, quality control, 26 staffing, records, reports and any other matters that may affect 27 the quality and reliability of laboratory performance. 28 (c) Laboratories to be inspected.--The department shall 29 periodically inspect and certify laboratories and laboratory 30 offices that meet the standards established under subsection 19880H2237B2960 - 2 -
1 (a). 2 (d) Notification.--In any case where the tests required by 3 section 8(c) indicate positive results, the testing laboratory 4 shall notify the public water supplier from which the sample was 5 obtained of the results within one hour after the test results 6 are confirmed. 7 Section 2.
