AN ACT 1 Amending the act of October 4, 1978 (P.L.876, No.169), entitled 2 "An act establishing the Pennsylvania Crime Commission and 3 providing for its powers and duties," further providing for 4 the duties of the commission and reports by the commission. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 4 of the act of October 4, 1978 (P.L.876, 8 No.169), known as the Pennsylvania Crime Commission Act, amended 9 April 30, 1986 (P.L.132, No.40), is amended to read: 10 Section 4. Powers and duties. 11 The Pennsylvania Crime Commission shall have the power and 12 its duty shall be: 13 (1) To inquire into organized crime and activities of 14 persons engaged in or associated with organized crime. 15 (2) To inquire into public corruption and the activities 16 of persons engaged in and associated with public corruption. 17 (3) In accomplishing the above duties, to perform the 18 function of intelligence, including collection, evaluation,
1 analysis and dissemination essential to the effective 2 operation of the commission during inquiry into the nature 3 and scope of organized crime. 4 [(3)] (4) To make a detailed written report of every 5 completed investigation which may include recommendation for 6 legislative or administrative action. 7 [(4)] (5) To account to the Governor, the Auditor 8 General and the General Assembly at the end of each fiscal 9 year for all moneys received and disbursed. 10 [(5)] (6) To submit, during April of each calendar year, 11 an annual report on the status of organized crime in the 12 Commonwealth to a joint public hearing of the Judiciary 13 Committee of the Senate and the House of Representatives. 14 NOTICE OF THE JOINT PUBLIC HEARING SHALL BE GIVEN TO ALL <-- 15 MEMBERS OF THE JUDICIARY COMMITTEES OF THE SENATE AND THE 16 HOUSE OF REPRESENTATIVES AT LEAST 15 DAYS PRIOR TO THE DATE 17 OF THE JOINT PUBLIC HEARING AND AN EMBARGOED COPY OF THE 18 ANNUAL REPORT SHALL BE PROVIDED TO THE COMMITTEE MEMBERS AT 19 LEAST 24 HOURS PRIOR TO THE DATE AND TIME OF THE JOINT PUBLIC 20 HEARING. The report shall include an evaluation of the manner 21 in which the performance of the commission is accomplishing 22 the functions mandated under this act. In addition the 23 commission shall submit other reports prepared pursuant to 24 this section and to present said reports at public hearings 25 of the committees of the Senate and the House of 26 Representatives having oversight responsibilities or 27 appropriate legislative jurisdiction of the subject matter of 28 said reports. 29 [(6)] (7) Through its chairman, to call upon the 30 department heads of State Government and State agencies for 19870H1684B2545 - 2 -
1 such information and assistance as is needed to carry out the 2 functions of the commission. 3 [(7)] (8) To require the attendance and testimony of 4 witnesses and the production of documentary evidence relative 5 to any investigation which the commission may conduct in 6 accordance with the powers given it. Such subpoenas shall be 7 signed by the chairman, the executive director and two 8 commissioners and shall be served by any person authorized to 9 serve subpoenas under the laws of the Commonwealth. 10 [(8)] (9) To appoint and fix the compensation of an 11 executive director who shall devote his full time to the 12 general supervision of all investigations and proceedings by 13 the commission. 14 [(9)] (10) To appoint and fix the compensation of such 15 other employees as the commission may from time to time find 16 necessary for the proper performance of the functions of the 17 commission. Investigative employees of the commission shall 18 be deemed law enforcement officers. 19 [(10.1)] (11) To promulgate and publish rules and 20 regulations, including those regulations controlling or 21 defining the: 22 (i) Calling of meetings. 23 (ii) Investigative responsibilities of commission 24 members. 25 (iii) Written procedures to be utilized by the 26 commission's investigative management staff in planning 27 and supervising investigations and inquiries. 28 (iv) Dissemination of materials, including 29 dissemination to the Governor and members or committees 30 of the General Assembly. 19870H1684B2545 - 3 -
1 (v) Appropriate use of commission property,
2 including all vehicles.
3 (vi) Maintenance of confidentiality of information.
4 (vii) All other procedures and acts as are necessary
5 for the proper functioning of the commission.
6 [(11)] (12) To perform such other acts as are necessary
7 for the proper functioning of the commission.
8 Section 2. This act shall take effect in 30 days.
