                                     AN ACT

     1  Providing for the establishment, administration and distribution
     2     of the Human Services Development Fund; and imposing
     3     additional powers and duties on the Department of Public
     4     Welfare.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Human
     9  Services Development Fund Act.
    10  Section 2.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Department."  The Department of Public Welfare of the
    15  Commonwealth.
    16     "Fund."  The Human Services Development Fund established in
    17  section 3.
    18     "Human services."  Services which provide care, assistance,


     1  housing, training, counseling, transportation and related
     2  services for the indigent, needy, deprived, neglected, mentally
     3  ill, mentally retarded, physically handicapped, abused,
     4  homeless, aged and other persons requiring assistance under
     5  standards established by the Federal or State government or by
     6  county governments.
     7  Section 3.  Human Services Development Fund.
     8     (a)  Establishment.--There is hereby established a separate
     9  account in the State Treasury, to be known as the Human Services
    10  Development Fund, for the purpose of providing discretionary
    11  grants to counties for human services.
    12     (b)  Administration.--The fund shall be administered by the
    13  department, which shall be responsible for determining the
    14  annual grant of each county and the semiannual reimbursement to
    15  the various counties based on the limitation of the annual
    16  appropriation and the distribution formula in section 4.
    17     (c)  Utilization.--Each county which receives an annual grant
    18  from the fund shall have the power to, and may, allocate that
    19  grant or any portion thereof for the provision of human
    20  services. All funds received in the form of a grant shall be
    21  used by the county solely for the provision of human services.
    22  Section 4.  Distribution of fund.
    23     (a)  Formula.--The annual grant to each county shall be
    24  determined by application of the following formula:
    25         (1)  Each county shall receive a minimum grant of $75,000
    26     per year.
    27         (2)  Seventy-five percent of the balance remaining after
    28     the application of paragraph (1) shall be distributed to each
    29     county on a per capita basis, multiplied by the number of
    30     county residents who are below the poverty level.

     1         (3)  Twenty-five percent of the balance remaining after
     2     the application of paragraph (1) shall be distributed to each
     3     county on a per capita basis.
     4     (b)  Reimbursement.--Each county shall be reimbursed on a
     5  semiannual basis by the department upon submission of vouchers
     6  and other evidence indicating performance of the services.
     7  Section 5.  Regulations.
     8     The department shall, in the manner provided by law,
     9  promulgate the rules and regulations necessary to carry out this
    10  act.
    11  Section 6.  Application of act.
    12     This act shall apply to all expenses incurred by counties
    13  after July 1, 1987, for the provisions of human services.
    14  Section 7.  Limitations.
    15     No county or city of the first class or county of the second
    16  class shall be eligible for funds under this act unless it has
    17  developed a community work experience program pursuant to
    18  section 405 of the act of June 13, 1967 (P.L.31, No.21), known
    19  as the Public Welfare Code, that satisfies minimal standards
    20  established by the department.
    21  Section 8.  Effective date.
    22     This act shall take effect July 1, 1987, or immediately,
    23  whichever is later.
