AN ACT 1 Requiring the superintendent of every public school district and <-- 2 the principal of certain parochial, licensed private and 3 nonpublic schools to make available, upon request, lists of 4 graduating seniors to armed forces recruiters; and providing 5 a penalty for the misuse of any such lists. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Legislative intent. 9 It is the intent of the General Assembly through this 10 legislation to assist armed forces recruiters to achieve 11 additional access to potential recruits by compiling a list of 12 prospective graduating seniors for distribution, upon written 13 request, to armed forces recruiters for the cost thereof, for 14 recruiting purposes only. 15 Section 2. List of seniors to be compiled. 16 (a) Lists.--Subject to the limitations of subsection (b), 17 the superintendent of every public school district and the <-- 18 principal of every parochial, licensed private and nonpublic
1 school, except as otherwise provided, shall compile a list of 2 senior students, both male and female, including home address 3 and published telephone number, who at the end of the respective 4 academic year will graduate from the school system. The list 5 shall be compiled within 45 calendar days of the effective date 6 of this act and in succeeding years by the first day of the 7 academic year in which the senior students will graduate. 8 (b) Notification.--Each school district shall notify the 9 students, in writing, prior to the end of their junior year, of 10 the requirements imposed by subsection (a). Each student shall 11 be given at least 21 calendar days to request, in writing, to 12 the superintendent or principal, exclusion of such student's <-- 13 name prior to the release of such list. 14 SECTION 3. OPTIONAL COMPLIANCE BY NONPUBLIC SCHOOLS. <-- 15 THE GOVERNING BODY OR BOARD OF EACH PAROCHIAL, LICENSED 16 PRIVATE AND NONPUBLIC SCHOOL SHALL DETERMINE WHETHER OR NOT TO 17 COMPLY WITH THE PROVISIONS OF THIS ACT. IF AN AFFIRMATIVE 18 DETERMINATION IS MADE, THEN THE PRINCIPAL OF THAT PAROCHIAL, 19 LICENSED PRIVATE OR NONPUBLIC SCHOOL SHALL COMPLY WITH THE 20 PROVISIONS OF SECTIONS 2, 4 AND 5 OF THIS ACT. 21 Section 3 4. List to be made available. <-- 22 The list shall be made available to armed forces recruiters 23 for the active component, the reserve component or the National 24 Guard component of the armed forces. 25 Section 4 5. Penalties. <-- 26 A person who violates this act commits a summary offense and 27 shall, upon conviction, be sentenced to pay a fine of $100. Each 28 day that a person violates this act shall constitute a separate 29 offense. 30 Section 5 6. Effective date. <-- 19870H1169B1980 - 2 -
