                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting smoking in school buses and other
     3     vehicles transporting school children; and providing a
     4     penalty for violations.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 75 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 4554.  Smoking prohibited.
    10     (a)  General rule.--Smoking is prohibited in all school buses
    11  and other vehicles transporting school children which are
    12  subject to this subchapter, except buses, other than school
    13  buses, operated by urban mass transportation systems for the
    14  nonexclusive transportation of school children.
    15     (b)  Penalty.--A person who violates this section commits a


     1  summary offense and shall, upon conviction, be sentenced to pay
     2  a fine of not more than $25.
     3     Section 2.  This act shall take effect in 60 days.
