AN ACT 1 Amending the act of February 9, 1984 (P.L.3, No.2), entitled "An 2 act providing for the education and training of deputy 3 sheriffs; creating the Deputy Sheriffs' Education and 4 Training Board under the Pennsylvania Commission on Crime and 5 Delinquency; providing for the powers and duties of the board 6 and the Attorney General; establishing the Deputy Sheriffs' 7 Education and Training Account; providing for a surcharge on 8 sheriffs' fees; and providing penalties," providing for the 9 fulfillment of education and training requirements at schools 10 certified by the Municipal Police Officers' Education and 11 Training Commission. 12 The General Assembly of the Commonwealth of Pennsylvania 13 hereby enacts as follows: 14 Section 1. Sections 4, 5 and 9 of the act of February 9, 15 1984 (P.L.3, No.2), known as the Deputy Sheriffs' Education and 16 Training Act, are amended to read: 17 Section 4. Powers and duties of the board. 18 The board, with the review and approval of the commission, 19 shall: 20 (1) Establish, implement and administer the Deputy 21 Sheriffs' Education and Training Program according to the
1 minimum requirements set forth in this act. 2 (2) Establish, implement and administer requirements for 3 the minimum courses of study and training for deputy 4 sheriffs. Deputy sheriffs who have successfully completed a 5 course of study equivalent to that set out in the Municipal 6 Police Officers' Education and Training Program, at a school 7 certified by the Municipal Police Officers' Education and 8 Training Commission for providing such training, shall be 9 deemed to have satisfied the requirements for a minimum 10 course of study and training. 11 (3) Establish, implement and administer requirements for 12 courses of study and in-service training for deputy sheriffs 13 appointed prior to the effective date of this act. 14 (4) Establish, implement and administer requirements for 15 a continuing education program for all deputy sheriffs 16 concerning subjects the board may deem necessary and 17 appropriate for the continued education and training of 18 deputy sheriffs. 19 (5) Approve or revoke the approval of any school which 20 may be utilized to comply with the educational and training 21 requirements of this act. In all cases where the sheriff of 22 the county chooses to have his deputies receive the municipal 23 police officers' basic training in lieu of the deputy 24 sheriff's basic training, any school which has been approved 25 for providing basic police training by the Municipal Police 26 Officers' Education and Training Commission shall be deemed 27 to have satisfied the requirements of this provision. 28 (6) Establish the minimum qualifications for instructors 29 and certify instructors. In all cases where the sheriff of 30 the county chooses to have his deputies receive the municipal 19870H1088B1210 - 2 -
1 police officers' basic training in lieu of the deputy 2 sheriff's basic training, any instructor who has been 3 certified by the Municipal Police Officers' Education and 4 Training Commission shall be deemed to have satisfied the 5 requirements of this provision. 6 (7) Consult and cooperate with universities, colleges, 7 law schools, community colleges and institutes for the 8 development of specialized courses for deputy sheriffs. 9 (8) Promote the most efficient and economical program 10 for deputy sheriff training by utilizing existing facilities, 11 programs and qualified State and local personnel. 12 (9) Certify deputy sheriffs who have satisfactorily 13 completed the basic education and training requirements of 14 this act, including those deputy sheriffs who have completed 15 the Municipal Police Officers' Education and Training 16 Program, and issue appropriate certificates to them. 17 (10) Make rules and regulations and perform other duties 18 as may be reasonably necessary or appropriate to administer 19 the education and training program for deputy sheriffs. 20 (11) Make an annual report to the Governor and to the 21 General Assembly concerning: 22 (i) The administration of the Deputy Sheriffs' 23 Education and Training Program. 24 (ii) The activities of the board. 25 (iii) The costs of the program. 26 Section 5. Training program. 27 The Deputy Sheriffs' Education and Training Program shall 28 include appropriate training for a total of 160 hours which 29 content shall be determined by regulation. In all cases where 30 the sheriff of the county chooses to have his deputies receive 19870H1088B1210 - 3 -
1 the municipal police officers' basic training in lieu of the 2 deputy sheriff's basic training, such training shall be deemed 3 to have satisfied the requirements of this provision. 4 Section 9. Reimbursement to counties. 5 (a) General rule.--The commission shall provide for 6 reimbursement to each county of 100% of the allowable tuition 7 and the ordinary and necessary living and travel expenses 8 incurred by their deputy sheriffs while attending certified 9 deputy sheriffs' basic training or continuing education schools 10 if the county adheres to the training standards set forth in 11 this act and established by the board with the review and 12 approval of the commission. The regular salary of deputy 13 sheriffs while attending approved schools shall be paid by the 14 employing county. Fifty percent of the regular salaries of 15 deputy sheriffs while attending approved schools shall be 16 reimbursed to the employing county. 17 (b) Alternative basic training.--In all cases where the 18 sheriff of the county chooses to have his deputies receive the 19 municipal police officers' basic training in lieu of the deputy 20 sheriff's basic training, the commission shall provide for 21 reimbursement to each county of 100% of the tuition cost which 22 would have been allowable had the deputies been trained under 23 the Deputy Sheriffs' Education and Training Program instead of 24 the Municipal Police Officers' Education and Training Program, 25 and the ordinary and necessary living and travel expenses 26 incurred by such deputies while attending training, insofar as 27 these expenses do not exceed what they would have been if such 28 deputies had been trained under the Deputy Sheriffs' Education 29 and Training Program instead of the Municipal Police Officers' 30 Education and Training Program. 1 sheriffs while attending training shall be paid by the employing 2 county. Fifty percent of the regular salaries of deputy sheriffs 3 while attending training authorized by this subsection, not to 4 exceed the total number of training hours established in section 5 5, shall be reimbursed to the employing county by the 6 commission. 7 Section 2.
