                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," imposing restrictions on
     5     county officers.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 402 of the act of July 28, 1953 (P.L.723,
     9  No.230), known as the Second Class County Code, is amended to
    10  read:
    11     Section 402.  Incompatible Offices and Restrictions of
    12  Office.--(a)  No elected county officer shall at the same time
    13  serve as a member of the legislative body of any city, borough,
    14  town or township of any class, nor as school director of any
    15  school district, nor as a member of any board of health.
    16     (b)  No member of Congress from this State nor any person
    17  holding or exercising any office or appointment of trust or
    18  profit under the United States shall at the same time hold or
    19  exercise any county office in this State to which a salary, fee

     1  or perquisites are attached.
     2     (c)  Each elected county officer shall devote full time to
     3  his official duties during the normal working hours of his
     4  office.
     5     (d)  Any elected county officer who seeks another elected
     6  office shall resign from his office upon the filing of a
     7  petition to run for an office other than that which he holds.
     8     Section 2.  This act shall take effect in 60 days.
