AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, prohibiting surrogate mothering.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 4305 of Title 18 of the Pennsylvania
6 Consolidated Statutes is amended to read:
7 § 4305. Dealing in infant children.
8 (a) Offense defined.--A person is guilty of a misdemeanor of
9 the first degree if he deals in humanity, by trading, bartering,
10 buying, selling, or dealing in infant children, or by
11 participating in a verbal or written agreement relating to the
12 practice of surrogate mothering.
13 (b) Definition.--As used in this section the term "surrogate
14 mothering" means doing any of the following for the purpose of
15 receiving financial compensation for providing a couple or
16 single person with a child:
17 (1) Becoming pregnant.
1 (2) Completing the gestation cycle of that pregnancy.
2 (3) Delivering the child of that pregnancy.
3 (4) Conspiring with or enticing another to become
4 pregnant, complete gestation and deliver the child of that
5 pregnancy.
6 Section 2. This act shall take effect in 60 days.
