        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MAY 4, 1987

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, authorizing handicapped, AND disabled veteran and    <--
     3     severely disabled veteran plates for motorcycles; AND FURTHER  <--
     4     PROVIDING FOR REVOCATION OF HABITUAL OFFENDER'S LICENSE.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 1338(a) and, 1342(a) and (c) AND 1542(B)  <--
     8  of Title 75 of the Pennsylvania Consolidated Statutes are
     9  amended to read:
    10  § 1338.  Handicapped plate and placard.
    11     (a)  Handicapped plate.--On the application of any person
    12  who:
    13         (1)  does not have full use of a leg or both legs, as
    14     evidenced by the use of a wheelchair, walker, crutches, quad
    15     cane or other such device;
    16         (2)  is blind;
    17         (3)  is physically limited by a cardiopulmonary
    18     condition, such as severe emphysema or chronic bronchitis,

     1     restricting substantially his movements;
     2         (4)  does not have full use of an arm or both arms; or
     3         (5)  is a parent or a person in loco parentis of a person
     4     specified in paragraph (1), (2), (3) or (4);
     5  the department shall issue a special registration plate for one
     6  passenger car or other vehicle, including a motorcycle, with a    <--
     7  registered gross weight of not more than 9,000 pounds,
     8  designating the vehicle so licensed as being used by a
     9  handicapped person. Special plates for handicapped persons may
    10  also be issued for vehicles operated exclusively for the use and
    11  benefit of handicapped persons. IN THE CASE OF A MOTORCYCLE, THE  <--
    12  DEPARTMENT SHALL ISSUE A DECAL CONTAINING THE INTERNATIONAL
    13  SYMBOL FOR HANDICAPPED ACCESS FOR DISPLAY ON THE REGISTRATION
    14  PLATE.

    16  § 1342.  Veteran plates and placard.
    17     (a)  Severely disabled veteran plate.--On the application of
    18  a veteran whose service-connected disability is certified at
    19  100% by the service unit of the armed forces in which the
    20  veteran served or by the United States Veterans' Administration
    21  or who has a service-connected disability of the type enumerated
    22  in section 1338 (relating to handicapped plate and placard), the
    23  department shall issue a special registration plate designating
    24  the vehicle as belonging to a severely disabled veteran. The
    25  registration plate shall have a white background, shall have
    26  blue numbers or letters as the department may determine, shall
    27  have the words, "disabled veteran," in at least ten-point bold
    28  type, inscribed in red at the bottom of the plate, and shall
    29  include the international symbol for handicapped access. Only
    30  one special registration plate shall be issued to a veteran

     1  under this section. It may be used only on one passenger vehicle
     2  or one other vehicle, including a motorcycle, with a registered   <--
     3  gross weight of not more than 9,000 pounds. IN THE CASE OF A      <--
     4  MOTORCYCLE, THE DEPARTMENT SHALL ISSUE A DECAL CONTAINING THE
     5  INTERNATIONAL SYMBOL FOR HANDICAPPED ACCESS AND THE WORDS,
     6  "DISABLED VETERAN," FOR DISPLAY ON THE REGISTRATION PLATE.

     8     (c)  Disabled veteran plates.--On the application of any       <--
     9  veteran having a disability certified by the service unit of the
    10  armed forces in which the veteran served or by the United States
    11  Veterans' Administration as service-connected, the department
    12  shall issue a special registration plate designating the vehicle
    13  as belonging to a disabled veteran. The registration plate shall
    14  have a white background, shall have numbers or letters as the
    15  department may determine and shall have the words "disabled
    16  veteran" in at least ten-point bold type inscribed at the bottom
    17  of the plate. Only one special registration plate shall be
    18  issued to a veteran under this section. It may be used only on
    19  one passenger vehicle or one other vehicle, including a
    20  motorcycle, with a registered gross weight of not more than
    21  9,000 pounds.

    23  § 1542.  REVOCATION OF HABITUAL OFFENDER'S LICENSE.               <--

    25     (B)  OFFENSES ENUMERATED.--THREE CONVICTIONS ARISING FROM
    26  SEPARATE AND DISTINCT ACTS OF ANY ONE OR MORE OF THE FOLLOWING
    27  OFFENSES COMMITTED [EITHER] SINGULARLY [OR IN COMBINATION] BY
    28  ANY PERSON SHALL RESULT IN SUCH PERSON BEING DESIGNATED AS A
    29  HABITUAL OFFENDER:
    30         (1)  ANY OFFENSE SET FORTH IN SECTION 1532 (RELATING TO

     1     REVOCATION OR SUSPENSION OF OPERATING PRIVILEGE).
     2         (2)  OPERATION FOLLOWING SUSPENSION OF REGISTRATION AS
     3     DEFINED IN SECTION 1371 (RELATING TO OPERATION FOLLOWING
     4     SUSPENSION OF REGISTRATION).
     5         (3)  MAKING USE OF OR OPERATING ANY VEHICLE WITHOUT THE
     6     KNOWLEDGE OR CONSENT OF THE OWNER OR CUSTODIAN THEREOF.
     7         (4)  UTILIZING A VEHICLE IN THE UNLAWFUL TRANSPORTATION
     8     OR UNLAWFUL SALE OF ALCOHOL OR ANY CONTROLLED SUBSTANCE.
     9         (5)  ANY FELONY IN THE COMMISSION OF WHICH A COURT
    10     DETERMINES THAT A VEHICLE WAS ESSENTIALLY INVOLVED.

    12     Section 2.  This act shall take effect in 60 days.
