AN ACT 1 Providing for concurrent jurisdiction between the United States 2 and the Commonwealth over certain parks and historic sites. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Concurrent jurisdiction. 6 (a) Grant CESSION of concurrent jurisdiction.--The <-- 7 Commonwealth of Pennsylvania hereby grants CEDES to the United <-- 8 States concurrent jurisdiction over lands, waters and buildings 9 within the boundaries of units OF THE NATIONAL PARK SYSTEM <-- 10 administered by the United States Department of the Interior 11 National Park Service, including those owned, leased or 12 administratively controlled by the National Park Service 90 days <-- 13 after the effective date of this act, as well as all lands and 14 buildings hereafter acquired, leased or administratively 15 controlled by the National Park Service. 16 (b) Sites affected.--The existing National Park Service 17 lands, waters and buildings affected are as follows:
1 (1) Allegheny Postage PORTAGE National Historic site. <-- 2 (2) Delaware Water Gap National Recreation Area. 3 (3) Edgar Allen Poe National Historic Site. 4 (4) Eisenhower National Historical HISTORIC Site. <-- 5 (5) Fort Necessity National Battlefield. 6 (6) Friendship Hill National Historic Site. 7 (7) Gettysburg National Military Park. 8 (8) Gloria Dei (Old Swede's) Church National Historic 9 Site. 10 (9) Hopewell Furnace National Historic Site. 11 (10) Independence National Historical Park. 12 (11) Johnstown Flood National Historical Memorial. <-- 13 (12) Thaddeus Koscuiszko National Memorial. 14 (13) Valley Forge National Historical Park. 15 Section 2. Conditions precedent. <-- 16 SECTION 2. ACCEPTANCE BY UNITED STATES. <-- 17 (a) Relinquishment by United States.--Cession of <-- 18 jurisdiction shall become effective when it is accepted on 19 behalf of the United States. Acceptance shall be indicated, in 20 writing upon the instrument of cession, by an authorized 21 official of the United States and filed with the Secretary of 22 the Commonwealth. 23 (b) Acceptance by Governor.-- <-- 24 SECTION 3. ACCEPTANCE BY GOVERNOR. <-- 25 (1) (A) RELINQUISHMENT BY UNITED STATES.--Whenever the <-- 26 United States tenders to the Commonwealth of Pennsylvania a 27 relinquishment of all or part of the legislative jurisdiction 28 theretofore acquired by it over lands within this State <-- 29 COMMONWEALTH, the Governor is authorized to accept, on behalf of <-- 30 the Commonwealth, the legislative jurisdiction so relinquished. 19860H2692B3941 - 2 -
1 (2) (B) PUBLICATION.--The Governor shall indicate his <-- 2 acceptance of relinquished legislative jurisdiction by a writing 3 addressed to the head of the appropriate department or agency of 4 the United States. This acceptance shall be effective upon the 5 publication of the writing in the Pennsylvania Bulletin. 6 Section 3. Effective date. <-- 7 This act shall take effect immediately. 8 SECTION 4. EFFECTIVE DATE. <-- 9 (A) SECTION 1 SHALL TAKE EFFECT IN 90 DAYS. 10 (B) THE REMAINDER OF THIS ACT SHALL TAKE EFFECT IMMEDIATELY. F4L29JAM/19860H2692B3941 - 3 -
