AN ACT 1 Amending the act of July 7, 1980 (P.L.380, No.97), entitled "An 2 act providing for the planning and regulation of solid waste 3 storage, collection, transportation, processing, treatment, 4 and disposal; requiring municipalities to submit plans for 5 municipal waste management systems in their jurisdictions; 6 authorizing grants to municipalities; providing regulation of 7 the management of municipal, residual and hazardous waste; 8 requiring permits for operating hazardous waste and solid 9 waste storage, processing, treatment, and disposal 10 facilities; and licenses for transportation of hazardous 11 waste; imposing duties on persons and municipalities; 12 granting powers to municipalities; authorizing the 13 Environmental Quality Board and the Department of 14 Environmental Resources to adopt rules, regulations, 15 standards and procedures; granting powers to and imposing 16 duties upon county health departments; providing remedies; 17 prescribing penalties; and establishing a fund," providing 18 for source reduction, source separation and recycling of 19 solid waste. 20 The General Assembly of the Commonwealth of Pennsylvania 21 hereby enacts as follows: 22 Section 1. The act of July 7, 1980 (P.L.380, No.97), known 23 as the Solid Waste Management Act, is amended by adding a 24 section to read: 25 Section 204. Recycling.--(a) The department shall adopt 26 guidelines setting forth criteria by which to evaluate the
1 completeness and feasibility of certain studies conducted to 2 determine a practical and achievable program for source 3 reduction, source separation and recycling of solid waste within 4 the area contemplated to be served by a solid waste facility. 5 (b) Such guidelines shall require, at the minimum, that 6 relative to the proposed program, due consideration shall be 7 given to: 8 (1) The composition of the waste stream, including the 9 types of commercial and industrial contributors, if any. 10 (2) The potential for source reduction of particular 11 elements of the waste stream or the diversion of particular 12 elements for reuse, processing or resale. 13 (3) The potential for the adoption of source separation 14 programs and the establishment of recycling centers by 15 contributing municipalities or private persons. 16 (4) The availability of markets for recyclable 17 materials. 18 (5) Methods and cost of collection and transportation of 19 recyclable materials. 20 (6) Local ordinances. 21 Section 2.
