                                     AN ACT

     1  Authorizing and directing the Department of Revenue to place an
     2     additional 1,000 Lotto machines in certain locations.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Statement of purpose.
     6     In an effort to preserve the independently owned retail
     7  stores which are, and have been, the anchors of Pennsylvania's
     8  neighborhoods, and to encourage their economic growth and
     9  development, the General Assembly authorizes 1,000 additional
    10  Lotto machines to be placed in accordance with this act.
    11  Section 2.  Additional machines.
    12     The Department of Revenue is authorized and directed to
    13  procure an additional 1,000 Lotto machines. This number shall be
    14  in addition to any machines in place or available for placement
    15  pursuant to any contract in existence on the effective date of


     1  this act. The placement of these 1,000 Lotto machines shall be
     2  at the discretion of the Department of Revenue, except that no
     3  restrictions regarding the placement of the machines shall apply
     4  except those set forth in section 3.
     5  Section 3.  Restrictions on placement.
     6     No Lotto machine may be placed pursuant to this act unless
     7  the retail outlet or business has been in business for at least
     8  one year and had gross sales of not less than $100,000 nor more
     9  than $250,000 for its fiscal year immediately preceding its
    10  application for a Lotto machine.
    11  Section 4.  Applications and regulations.
    12     The Department of Revenue shall provide sufficient
    13  applications for placement of Lotto machines, and shall adopt
    14  regulations necessary to carry out this act.
    15  Section 5.  Funding.
    16     All funding necessary to carry out this act shall be
    17  appropriated from the State Lottery Fund.
    18  Section 6.  Effective date.
    19     This act shall take effect in 60 days.
