           AMENDED, JUNE 30, 1986

                                     AN ACT

     1  Amending the act of July 1, 1978 (P.L.584, No.109), entitled "An
     2     act establishing an agency to create the linkage necessary
     3     for the planning of an economic development system for
     4     Pennsylvania, and making an appropriation," further providing
     5     for powers and duties of council, and for the operation and
     6     functions of area labor management committees.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 6 of the act of July 1, 1978 (P.L.584,
    10  No.109), known as the Milrite Act, is amended to read:
    11  Section 6.  Powers and duties of council.
    12         (1)  Undertake research and investigation relating to the
    13     promotion of the industrial potential of Pennsylvania.
    14         (2)  Create plans for economic revitalization of
    15     Commonwealth industries.

     1         (3)  Recommend implementation procedures for all plans,
     2     maximizing existing mechanisms with proven ability to
     3     accomplish tasks, linkages among current programs, business,
     4     labor and government insights into practicality and
     5     workability of suggested approaches.
     6         (4)  Encourage and stimulate cooperation and coordination
     7     among Federal, State and local programs.
     8         (5)  Recommend structural changes and updating of
     9     economic delivery tools of State Government to the Governor
    10     and General Assembly.
    11         (6)  Draw upon labor, management and government
    12     participants to promulgate plans and implement procedures.
    13         (7)  Recommend organizational structure and participants
    14     particularly suited to local needs and conditions.
    15         (8)  Undertake research, including the hiring of
    16     consultants, into the cost of doing business in this
    17     Commonwealth, including recommendations for changes and
    18     estimates of future costs, with comparative analysis of both
    19     intrastate and interstate costs.
    20         (9)  Undertake research, including the hiring of
    21     consultants, to determine if the Commonwealth can more
    22     effectively use its mediation services to discourage, and
    23     shorten the duration of, labor-management disputes.
    24         [(8)] (10)  The council shall have the power to:
    25             (i)  Enter into contracts.
    26             (ii)  Appoint, fix compensation of, and prescribe
    27         duties of an executive director, secretary and such other
    28         personnel as the council deems necessary to accomplish
    29         the purposes of this act. The council shall be able to     <--
    30         appoint or discharge employees without being required to

     1         make a request of any executive agency. It is the intent
     2         of this provision that the council can function
     3         effectively only as an agency independent of any other
     4         branch of government.
     5             (iii)  Retain counsel.
     6             (iv)  Accept grants from public and private sources.
     7             (v)  Borrow money and issue obligations, secured or
     8         unsecured, to acquire, hold, own and pledge or dispose of
     9         funds, money, securities and other property, real or
    10         personal, tangible or intangible to the extent necessary
    11         to carry out the purposes of this act.
    12             (vi)  Adopt and promulgate rules and regulations
    13         necessary to accomplish the provisions of this act.
    14  Agencies of the Commonwealth shall provide their full
    15  cooperation to research conducted by the council, including, but
    16  not limited to, the provision of information necessary for
    17  conducting research under paragraphs (8) and (9).
    18     Section 2.  Section 6.1 of the act, added May 31, 1984
    19  (P.L.378, No.77), is amended to read:
    20  Section 6.1.  Area labor management committees.
    21     (a)  The council shall establish standards and criteria for
    22  the selection of area labor management committees to be assisted
    23  by [[matching]] grants under subsection (c), solicit proposals    <--
    24  from area labor management committees, review and evaluate the
    25  relative merits of such proposals and select those proposals for
    26  funding which would best meet the standards and criteria
    27  established by the council.
    28     (b)  The council may use a reasonable amount of any
    29  appropriation for grants to area labor management committees to
    30  hire staff and provide support for area labor management

     1  committees and for carrying out the purposes specified in
     2  subsection (a). Funds shall be used for staff and other expenses
     3  necessary to perform out-reach functions to those areas of the
     4  Commonwealth not served by area labor management committees.
     5     (c)  The council shall designate the area labor management
     6  committees which are entitled to receive [[matching]] grants      <--
     7  pursuant to subsection (a). Funds appropriated to the Department
     8  of Commerce for grants to area labor management committees shall
     9  be made to those committees, in amounts and under conditions
    10  specified by the council, and under the following conditions:
    11         (1)  The grant shall be matched with as much non-State
    12     funds as possible, within the overall goal of attempting to
    13     establish and maintain as many area labor management
    14     committees as possible.
    15         (2)  While the highest priority for these funds shall be
    16     for the establishment of new area labor management
    17     committees, the council shall make use of the money available
    18     to it for the grants to ensure the continued existence and
    19     expansion of existing area labor management committees,
    20     including the provisions of technical assistance and
    21     nonmatching grants.
    22     (d)  The council shall report annually to the chairman and
    23  minority chairman of the Senate Committee on Appropriations, the
    24  chairman and minority chairman of the House Committee on
    25  Appropriations, the chairman and minority chairman of the Senate
    26  Committee on Labor and Industry and the chairman and minority
    27  chairman of the House Committee on Labor Relations, the
    28  accomplishments and specific expenditures of each area labor
    29  management committee funded under subsections (a) and (c)
    30  including, but not limited to, salaries, rent, contracts and

     2     Section 3.  This act shall take effect immediately.
