                                     AN ACT

     1  Amending the act of July 2, 1984 (P.L.561, No.112), entitled "An
     2     act establishing the Pennsylvania Conservation Corps; and
     3     making an appropriation," further providing for referrals,
     4     for the wages of crewleaders and for guidelines and
     5     regulations; making an appropriation; and making a repeal.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Sections 6, 8(e), 11 and 12 of the act of July 2,
     9  1984 (P.L.561, No.112), known as the Pennsylvania Conservation
    10  Corps Act, are amended to read:
    11  Section 6.  Eligibility for program.
    12     (a)  Criteria.--Persons participating in the corps program
    13  shall be young men and women who are:
    14         (1)  Between the ages of 18 and 21.
    15         (2)  Economically disadvantaged.
    16         (3)  Domiciled in the Commonwealth for at least six


     1     months prior to participating in the program.
     2         (4)  Registered with the Office of Employment Security
     3     for employment.
     4         (5)  Physically and mentally capable of performing labor
     5     intensive work.
     6         (6)  Not attending high school or postsecondary
     7     institution full time and who provide assurance that they did
     8     not leave school for the purpose of participating in the
     9     program. Full-time high school and postsecondary students may
    10     participate in this program during authorized school
    11     vacations.
    12     (b)  Referrals.--Eligibility for corpsmembers shall be
    13  determined by the Office of Employment Security which shall
    14  refer eligible participants to the department. For referral
    15  purposes, the Office of Employment Security shall develop
    16  standards for classifying applicants into various levels of
    17  eligibility, based on the degree to which an applicant is
    18  economically disadvantaged, in accordance with applicant local
    19  labor supply. The Office of Employment Security shall refer
    20  applicants by order of classification, giving first priority to
    21  applicants whose eligibility is based on financial status as
    22  required by joint or separate employment programs of the Federal
    23  and State governments. If the number of corps jobs is
    24  insufficient to employ all eligible individuals who apply for
    25  participation in the program, the Office of Employment Security
    26  may provide the names of these eligible individuals to private
    27  sector employers or to job training programs requesting
    28  referrals, so long as the individuals referred agree to the
    29  referral being provided.
    30  Section 8.  Supervisors.

     2     (e)  Hourly wage.--Crewleaders shall receive an hourly wage
     3  that does not exceed the hourly wage of corpsmembers by more
     4  than [$2.00] $4.00.
     5     * * *
     6  Section 11.  Guidelines and regulations.
     7     (a)  [One-year] Temporary exemption from review.--In order to
     8  facilitate the speedy implementation of this program, the
     9  department shall have the power and authority to promulgate,
    10  adopt and use guidelines which shall be published in the
    11  Pennsylvania Bulletin. The guidelines shall not be subject to
    12  review pursuant to section 205 of the act of July 31, 1968
    13  (P.L.769, No.240), referred to as the Commonwealth Documents
    14  Law, sections 204(b) and 301(10) of the act of October 15, 1980
    15  (P.L.950, No.164), known as the Commonwealth Attorneys Act, or
    16  the act of June 25, 1982 (P.L.633, No.181), known as the
    17  Regulatory Review Act, and, except as provided in subsection
    18  (c), shall be effective [for a period not to exceed one year
    19  from the effective date of this act] until July 2, 1987.
    20     (b)  Expiration of exemption.--Except as provided in
    21  subsection (c), after [the expiration of the one-year period]
    22  July 2, 1987, all guidelines shall expire and shall be replaced
    23  by regulations which shall have been promulgated, adopted and
    24  published as provided by law.
    25     (c)  Exception.--The General Assembly may provide for an
    26  extension of the guidelines adopted pursuant to subsection (a)[,
    27  if the Leadership Committee established pursuant to sections 3
    28  and 4 of the act of December 22, 1981 (P.L.508, No.142), known
    29  as the Sunset Act, extends the guidelines adopted pursuant to
    30  subsection (a)].

     1  Section 12.  Appropriation.
     2     [For State fiscal year 1984-1985, the sum of $7,500,000 is
     3  hereby appropriated to the Department of Environmental Resources
     4  from the Pennsylvania Economic Revitalization Fund.] The sum of
     5  $4,720,000 is hereby appropriated to the Department of
     6  Environmental Resources from the Pennsylvania Economic
     7  Revitalization Fund for the fiscal period July 1, 1986, to June
     8  30, 1988. All funds from this appropriation shall be expended by
     9  the Department of Environmental Resources by June 30, 1988. No
    10  more than 25% of the funds available annually for this program
    11  may be expended on work experience projects which are submitted
    12  by local agencies and approved by the secretary. No more than 3%
    13  of the funds available for this program may be expended on
    14  program administration.
    15     Section 2.  Section 13 of the act is repealed.
    16     Section 3.  (a)  Section 1 of this act, insofar as it relates
    17  to sections 8(e) and 12 of the act, shall take effect July 1,
    18  1986.
    19     (b)  The remainder of this act shall take effect immediately.
