AN ACT
1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2 act to consolidate, editorially revise, and codify the public
3 welfare laws of the Commonwealth," providing for deductions
4 from monthly assistance payments for payments to landlords
5 for rent in certain cases.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The act of June 13, 1967 (P.L.31, No.21), known
9 as the Public Welfare Code, is amended by adding a section to
10 read:
11 Section 408.2. Rental Payments to Landlords.--If, upon the
12 petition of any landlord and after a hearing, the county board
13 finds that a tenant who is a recipient of public assistance owes
14 the landlord rent in an amount equal to or greater than three
15 monthly rental payments, then the board shall notify the
16 department to deduct an amount equal to one and one-third
17 monthly rental payments from each monthly assistance payment and
18 pay the amounts deducted to the landlord until such time as all
1 the rent owed is paid. The department shall make the deductions
2 required by this section to the fullest extent not inconsistent
3 with Federal statute or regulation and shall make every effort
4 to obtain a waiver of any inconsistent Federal requirement.
5 Section 2. This act shall take effect in 60 days.
