                                     AN ACT

     1  Requiring retail gasoline dealers to post gasoline additive
     2     information; and imposing penalties.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Gasoline
     7  Additive Labeling Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Co-solvent."  An alcohol, including ethanol, with higher
    13  molecular weight than methanol which is blended with methanol to
    14  prevent phase separation in gasoline.
    15     "Gasoline."  A liquid prepared, advertised, offered for sale,
    16  sold for use or used for the generation of power for the
    17  propulsion of motor vehicles, including any product obtained by


     1  blending together any one or more products of petroleum with or
     2  without other products, if the resultant product is capable of
     3  the same use.
     4     "Gasoline additives."  Methanol or a co-solvent.
     5     "Retail service station dealer."  A person, firm or
     6  corporation maintaining a place of business where gasoline is
     7  sold and delivered into the tanks of motor vehicles.
     8  Section 3.  Posting of gasoline additive information.
     9     (a)  Requirement.--All retail service station dealers shall
    10  conspicuously post, on each pump from which gasoline containing
    11  gasoline additives is dispensed, a sign clearly indicating the
    12  presence of the gasoline additives and the maximum percentage by
    13  volume, to the nearest whole percent, of each gasoline additive.
    14     (b)  Size of sign.--The information required by subsection
    15  (a) shall be conveyed in bold block lettering at least one-
    16  quarter inch in size.
    17     (c)  Pump signs.--If a pump is used to dispense gasoline on
    18  more than one driveway, the sign required by subsection (a)
    19  shall be placed on both sides of the pump.
    20  Section 4.  Federal requirements.
    21     It shall be unlawful to sell or offer for sale any gasoline
    22  containing gasoline additives where the blend or mixture is in
    23  violation of the specifications or the registration requirements
    24  established by the United States Environmental Protection Agency
    25  pursuant to section 211 of the Clean Air Act (Public Law 95-95,
    26  42 U.S.C. § 7545).
    27  Section 5.  Penalties.
    28     Any retail service station dealer who fails to comply with
    29  the provisions of this act commits a summary offense and, upon
    30  conviction thereof, shall, for the first offense, be sentenced

     1  to pay a fine not exceeding $200, and for a second and each
     2  subsequent offense, be sentenced to pay a fine not exceeding
     3  $300.
     4  Section 6.  Effective date.
     5     This act shall take effect in 60 days.
